If they deny they was smoking and commitee , believe they were smoking, then it's a 2 week ban

I think your council are acting way above the powers parliament gave them. [-X

The penalty for smoking in a taxi is a fixed penalty, and if the fixed penalty is refused then a court will decide on the guilt or not.

It seems your council are bypassing the agreed process as laid down by parliament.

I suggest you tell the lads never to admit to smoking in cabs, thus ensuring the proper process is adhered too.

All that said, it does kill so please stop.


Maybe It's caused by cosy "B" list LA solicitors who would possibly never make the cut in either Private nor Business Law where their neck would be on the line if they got it wrong..

The OP's lucky he's not being fined under the ant-smoking legislation then. He should KNOW it's been an offence now for quite a few years to smoke in a place of work or on public transport.

Mrs.roythebus is a town councillor and is always hearing complaints from her passengers about other cab drivers smoking in their cars. there's little she can do except tell them to complain to the licencing officer and travel with us in future!

I'd be firing off a letter to the Ombudsman outlining the councils attitude towards drivers and their Kangaroo court attitude.
