Am not scared of anything. I'm trying to figure out how a guy in my area can run an 8 seater as a taxi without any license of any sort. Despite numerous complaints to police from all other taxi operators he is still going about. So maybe I can do it too. I just can't work out what system he is using.

Now, i don't know how things are up there but down here we have a very simple and successful way of finding out such information. It is called asking the person concerned.

lots of reasons for going down the CH route,

maybe the council wont grant him a badge,

maybe he wants to use a vehicle the council wont permit(some councils are arsey about certain vehicles


very easy exemption to blag, I know a few operators running via CH for airport transfers and the like, ranging from older people carriers to brand new 50k vw shuttles.

interesting loophole nonetheless.

i'm currently contemplating putting a tourneo on PH in Glasgow, but the council are notoriously difficult when it comes to plating more unusual vehicles.

now I can either jump through hoops with GCC spend lots of money modifiying the vehicle, paying extra test fees to make sure it meets approval or I can plate it with a council outside Glasgow which is outside my working area or I could just say bugger the lot of you and go CH with no faff no tests and no oversight.

councils and the Scottish government really have dropped the ball with this one

Taxis and Private Hire Cars
Since the end of 2011, officials have been reviewing information produced on the
taxi and private hire car licensing regime to date and have had fresh discussions with
stakeholders, including a public consultation which ran from 28 November 2012 to
15 March 2013. Sixty eight responses were received during the public consultation
from a wide variety of interests including: trade, local licensing authorities, police,
passenger groups, disability organisations, the Law Society of Scotland, the
Information Commissioner‟s Office and the Office of Fair Trading. In addition,
officials attended a number of meetings to discuss the consultation. Representatives
at these meetings included, passenger groups (primarily focussed on passengers
with disabilities) local authority officials with responsibility for licensing, police and
trade (taxi, private hire and contract hire).
Proposals on extending testing to private hire car drivers gathered the most wide-spread support.
The removal of the contract exemption was largely welcomed by the
currently licensed trade, most local authorities and police. However, those working
under the current contract exemption were concerned about the detail of how local
licensing regimes would develop. We intend to delay commencement to prepare for
a smooth transition for all those involved.
Views on the introduction of a power to
refuse private hire car licences on the basis of overprovision received a mixed
response. In general, local licensing authorities which currently restrict taxi licenses
were largely in favour while those who do not, were not in favour. However, the Bill
will introduce a power for local licensing authorities to refuse an application, it will not
require them to do so.

Thank you for a useful response to my op.

So can you explain for me .... to go CH ... I just need a vehicle of any sort and an insurance policy ..... nothing else ?

Thing is whilst I have a taxi plate on my current vehicle I am planning to get into day tours with a local tour organiser. I want to buy another vehicle to be used exclusively for this business.

You would also need some proper written and signed contracts for every job that you do so that you can prove that you are operating correctly. You would also need to be certain that the hire or reward insurance that you get will cover the use of an unlicensed vehicle. Don't forget that this exemption will soon be removed in Scotland.
