If the council say it falls outside of the 1976 act, then how can they stipulate any conditions?

The issue is how much are the parents paying, if it's more than the voluntary rate then they should be licensed as a taxi, a PH or a bus.

That's the law.

If the council had decided they where PH, could the nursery's have applied to the traffic commissioner for a licence ??, taking them out of the council's control

no. If the vehicles are 8 passenger or less then it is Council. Unless of course you run a big bus operation and the small vehicle is a small part of that operation.

Thought there you could run a 4 seater off a restricted PSV, or to put it better I've never seen anything in writing that says you can't.

Only if it is part of a big bus operation. The system has been changed somewhat because of the stretched limo situation. You now have to sign a declaration to say that you wont use a small vehicle unless you have specifically licensed for something like a stretched limo and you have to jump through many hoops to keep it legal.
