Personally I wouldn't trust ANY guidelines the DfT dish out. After all it was the DfT who gave guidelines saying it was ok for s19 operators to get away with what they've been getting away with for about 20 years.

The European court rulings make it crystal clear what commercial activity is. Martin Allen has spoken at great length with the law makers in Brussels (boo hiss depending on your outlook) and they have said that though one ruling deals with tachographs on goods vehicles, it can equally be applied to passenger vehicles; another case deals with so-called voluntary hospital transport services applies to all passenger transport; another tacho case as to when a tacho needs to be used can apply equally to passenger vehicles. The SwallowHotels case in the UK adequately deals with our "misguided" definition of hire and reward, and as we all know there's been cases on here dealing with small vehicle hire and reward cases such as the "pink ladies" in Luton.

In my view and that of the Brussels law makers applies to goods vehicles, passenger vehicles over 9 seats and passenger vehicles under 9 seats.
Quite why this country has such a selective blinkered outlook on law enforcement when it comes to things that will benefit the government is debatable. No grey areas, just very clear judgements.
