Section 222 Local Government Act 1972 allows a Council to prosecute re.Safety of persons within the District.
No insurance on a motor vehicle or any vehicle what ever its form would fall foul of this Section as it would be endangering the safety of persons within the District.

I wouldnt say that a vehicle not having insurance is any less safe than one that does. Surely they are both at equal risk of being in an accident ?

To a degree yes, but often no insurance goes with no tax or MOT, and in many cases no driving license.

I'm told the hearing next week is a case management hearing for the trial in the next few months.

I'm also very interested to follow the 'plying for hire' issue. Especially in light of recent guidance published by the LGA.

On page 38 it gives advice on what councillors should look at when licensing operators, in particular app based operators. :-k
