10. PHV driver’s licences and badges (s10, 12 and 14 1998 Act)
It is an offence to drive a PHV which is being used as a PHV without a PHV
driver’s licence and badge. Anyone who does so commits an offence
punishable upon summary conviction to a fine not exceeding level 4.
Any licence holder who uses a PHV without a disc showing it to be a licensed
vehicle (unless granted an exemption by the Licensing Authority) is also guilty
of an offence punishable upon summary conviction to a fine not exceeding
level 3.
It is a requirement that when the driver is driving a PHV which is being used
as a PHV, he must wear the PHV driver’s badge issued so that it is plainly and
distinctly visible (unless granted an exemption by the Licensing Authority).
Failure to comply with this requirement is punishable upon summary
conviction to a fine not exceeding level 3.

I think that was just the starting fee, in the same way as licensing a PH under the 1976 act was put at about a fiver. :shock:

The problem is the Congestion Charge is camera enforced. How do they know when a registered Minicab is being used as a Minicab, or being used by Mr Bloggs to avoid paying the £8 a day. I don't think this is restricted to the top end of the market, builders van's, Astra's and god knows what else carry Minicab PCO stickers.

The people at SGS simply enter the vehicles details on a computer, which in turn is linked into the company who run the Congestion Charge.

I can't see a way the CC part of this can be enforced, but the PCO should be able to check that every driver of a licensed London PH is a licensed London PH by opening their eyes, getting off their bums and getting out to check for themselves. :wink:

I can't believe this bit;

Minicab exemptions are obtained by paying an £82 registration fee followed by a £27-a-year licence fee. Exploiting the loophole can save motorists more than £1,500. There are claims of builders and pick-up truck firms registering their vehicles as minicabs.
