WITH REFERENCE TO THE QUESTION YOU ASKED SHIRLEBUTT, I HAVE READ THE POSTING, AND YOU SAID IT WAS THE TALK OF THE RANKS, WELL SORRY I AM WITH HER ON THIS I ALSO WAS NOT AWARE OF IT, EVEN ASKED SECRETARY OF TOA AND NO ONE KNEW WHAT I WAS GOING ON ABOUT. RECENT PLATES SOLD THAT I AM AWARE OF WHICH MAY HELP JUDGE THE PLATE VALUES ARE AS FOLLOWS,
JULY 2004 R REG FAIRWAY WITH LICENSE 31,500
MAY 2005 V REG METRO " " 34.000 ABT MAY HAVE BEEN 33
SEPT 2005 P REG METRO " " 23,000
OCT 2005 P REG FAIRWAY 24,000

:twisted: I think i am right in this maybe
just a small piont but the plate on the back of your cab has no value it belongs to the local council
which they will renew every 12 months if you still fit there criteria.
Its the good will that has the value :twisted:

Actually they are not his yet he doesnt own them TMBC do unless he can get the decision over-ruled about the 12mths so no he cant do with them what he dam well likes otherwise so could the other 103 Image


Oh! I think TMBC are in for a very rude awakening much sooner than you think.

The licenses have been granted under the very same conditions that apply to everyone else who holds a prorietors license. Additional unlawfull conditions are not part and parcel of the court ruling. Then again you wouldn't know that would you?

You obviously also don't know that existing case law states a council cannot attache such terms to a license which in effect makes the granting of that license inferior to the grant of every other license by virtue of a condition that only applies to said license.

Now i'm not going to point you in the direction of the particualr case law because there is not just one case, there happens to be several. However to put you out of your misery I'll let you know exactly what the terms of reference were for the issuing of these five licenses.


Judge Lyons:- Have you made the decision?

Mr. Roxborough:- Yes

Judge Lyons:- What have you decided?

Mr. Roxborough:- Not to………

Judge Lyons:- Not to oppose the appeal.

Mr. Roxborough Yes.

Judge Lyons:- May I say how very sensible that is. In the circumstances, therefore, the appeal is allowed.

Mr. Roxborough:- Your Honour, may I explain two things, really for the applicants benefit.

Mr. Roxborough:- Firstly, procedurally what happens next is effectively this matter is remitted back to the Licensing Committee, which next sits on the 3rd November (the applicant is aware of that) and the recommendation is that the applicants application be allowed. I have explained to the applicant because he was concerned (the local authority has certain criteria about the type of vehicle and the nature of the vehicle that can be used in their roadworthiness etcetera) that additional conditions in terms of the vehicle (that they must be pink or something like that, he did not say that, I have just plucked that out of thin air), "but some ludicrous condition may be imposed to thwart the granting of his licence. That is not going to happen, the criteria are as they are and will remain as they are".

Judge Lyons:- So there will be no change in the established criteria and there can be no opposition to the granting to him of a licence.

Mr. Roxborough:- No, in actual fact there are five licences requested.

Judge Lyon:- That seems to be the case, you are happy with that?

Mr. Roxborough:- Your Honour, yes. The application was initially for one, then became five and that is what is going to go before the Committee.

Judge Lyons:- You have succeeded. It is a pity that you had to go to all this trouble, but you have succeeded.

The Appellant:- We did try to sit down and sort it out, but they did not want to know.

Judge Lyons:- There it is, it sometimes requires them to have their own legal advice. Is there anything else that either of you need me to do.

Mr. Roxborough:- No

The Appellant:- No

Judge Lyons: - Very good, then the appeal is allowed to that extent.


So when this goes back to court which it most certainly will, Trafford better have a dam good excuse as to why they placed conditions on the applicants license when Trafford told Judge Lyons that no such conditions would be applied.

Perhaps Trafford could do with an upgrade of licensing personnel and perhaps you guys should involve yourself more in how the law applies to the taxi trade instead of blindly being lead by second rate reps.

WITH RESPECT IF YOU READ THAT VERY CLOSELY IS IT NOT IN FACT JUST REFERRING TO THE VEHICLE NOT THE LICENSE.

DOES NOT MENTION CRITERIA WITH REGARDS TO LICENSE JUST VEHICLE.
THINK THATS WOT TRAFFORD ARE GOING ON.

There is no good will in owning a plate . If you had a PH company and you had regular customers , you sold the business and it was 100% likely, that the same customers would carry on using, the firm you sold ,that would be good will . There is no more likely hood of customers useing your cab , as any one elses . You have no good will to sell streetcar. YOU HAVE NO GOOD WILL TO SELL . .

THE PROBLEMS WITH TRAFFORD HACKNEYS IS THEY ARE TOO BUSY ARGUING AMONGST THEMSELVES TO GET ANYWHERE, HAVE TO IDEA HOW TO STICK TOGETHER.

:twisted: As a cab driver with my own cutomers if i was to sell my business i would also pass on my regular customers as not to let them down now i am sure thats goodwill :twisted:

Well as I have previously stated this situation only came about because of the unwillingness of Trafford council to undertake a survey. I don't know if the Trafford Taxi trade informed Trafford council of the importance of such a survey but the rest is history. We on TDO bear no animosity towards Trafford, we only report the news and try and furnish the Taxi trade with the facts. Sometimes the facts are unpallatable but at least you know what to expect on TDO regardless of the way you wish to digest those facts.

I hope you appreciate that?

I have heard some one is about to apply, for 20 plates so i dont know what the number of plates is. So there is no unmet demand in Trafford well your there i am not calling you a liar , but come on ..
