Well, let's just say more accessible than a standard saloon car but less accessible than the full WAV spec, assuming that's ever finalised. OK, a swivel-seat doesn't make a saloon a WAV as such, but it's more accessible than a standard saloon.

I can't really see that happening, in the next decade or two at least, but as I said your question merely related to the theory of why a PH sector might persist even if both they and HC were required to have WAVs. Or semi-WAVs :)

As for your the general thrust behind your question above, you could ask that about a million and one LA policies.

Mr Mathews is being put in a position whereby he has to purchase a WAV at great expense and not be able to use the vehicle for what it is designed and built to be used for I could understand him being put in that position in a city which is 100% WAV but sound ludicrous to be asked to do so in a city which has a 2 tier system.
Its like asking for a pair of running shoes when your confined to a wheelchair pretty pointless huh.

Toots put yourself in Mr Mathews shoes

Bruce has ran a HC licence for the past 11 years why should he be put in a position to down grade to PH when it's not his fault he ended up being disabled you can't use legislation against him to provide a service for the disabled and not use the same legislation to work for his disability, they can't have it both ways.

The legislation has to take into account all parties needs

Providing the driver is the only one allowed to drive said hackney, I think his application to stay/go saloon should be accepted.

No sense at all making a driver go WAV when he is medically unfit to do WAV work.

'Wednsebury' unreasonable in my opinion.

What do you mean down grade :shock: :wink: I did put myself in his shoes, not being able to safely load a wheelchair, but, obviously not because of a disability. The decision I made suited me at the time. I was just suggesting an alternative if all else fails :D

So presumably there are saloon owners in Dundee forced into the inferior PH option in Dundee rather than run an HC, so what would be the great hardship for him if he had to do that instead of get a saloon HC licence?

Or are you saying that PH saloons in Dundee are inferior to HC saloons in Dundee?

What are the vehicle conditions? Are they different?
