I think a case could be made that a so-called self-employed driver is in fact an employed version, if:

The operator owns and insures the motor.

The driver only does work for that operator.

And/or the operator takes a % of the take.

In this Five Star graded company methinks that's the case.

Or perhaps if you look at the working time directive on what constitutes self employed.....although i guess someone will say that ain't relevant because its the HMRC rules that apply?

and its HMRC who come round and ask for the 7 years back-dated tax and stamp that the base/car owner/renter should have been paying from the driver in the car, and dont worry if you havent kept records, cos HMRC are happy to estimate** them for you....

you can run, but you cant hide..........

The Penman and Sommerlad article in today's Mirror " SLAVE WAGE CABBIE CON" shows the disgraceful way that migrant labour is cynically exploited by unscrupulous employers in the private hire industry in this country and in London in particular.

The City of London and Canary Wharf isn't the only place that gangsters and crooks have made hay while officials from government regulatory bodies turn a blind eye.

For the last couple of years the professional drivers branch of the GMB union has raised the issue of bogus employment in the cab trade at the Public Carriage Office pointing out that giving the topographical testing of the drivers to the employers was a recipe for disaster. It was like putting Dracula in charge of the blood bank.

What happens is that all drivers should be criminal record checked to ensure there are no unsavoury characters transporting the public. There should be a medical to ensure that drivers are fit enough to do the job. There is also topographical testing to ensure that the prospective drivers know their way around. The ability to communicate, map read and calculate is an essential pre requirement for that.

Such testing should clearly be undertaken by an independent body such as a local authority or an education provider. The responsibility for this was instead given to mini cab proprietors who have a vested self interest in securing as many drivers as possible as it is their rents that makes the proprietors rich.

How and where these particular Romanian drivers passed their tests to obtain a licence is anybodies guess.

In addition if it isn't bad enough that the public haven't got a guarantee that they are driven by a fully competent and efficient driver any chance of improving the situation through training is now being jeopardised by unscrupulous proprietors obtaining training money directly from the government and then trousering large quantities of it rather than ensuring adequate training is arranged.

But the final insult must be the fact that the Public Carriage Office have known since last June that drivers have not been receiving an enhanced criminal record check allegedly because of a bureaucratic misunderstanding. After recent revelations of the case of a serial rapist driving a black cab in London one would have thought that it was a matter of urgency for our so called regulators to rectify. Instead they have chosen to do nothing other than expel the union from it's meetings for raising these issues.

The next time your cab turns up an hour late, the driver doesn't know where he is going and can't understand you and them overcharges you look on the bright side at least you haven't been driven by something even worse that hasn't had their criminal record checked properly.
