Whether DCC knew that 203020 were unlicenced isn't the point here.
Licences did exist for these vehicles. The interdict was to give the court time to sort out whether they were held by the same company that operated them.
203020 were granted an interdict to stop DCC revoking their licences until the court decided on 203020's case.
If you don't renew your licence, you make yourself unlicenced and there is no case to prove in court. Therefore no interdict would be granted.

Whether DCC knew 203020 was not the licence holder 9 months previously was not the reason the interdict was granted.
When the issue of which company held the licences was decided, the licences were still revoked.

No sheriff will allow someone to act illegally just because the council allowed someone else to on a previous occasion.
They will apply the law in each case before them.
The law says that if you don't apply and pay for your renewal - you are unlicenced.

Anyone got the Dundee council solicitor's email address.

I'll send him ny Breaching Human Rights report.

Meanwhile, isn't it curious that Aberdeen's solicitor reckons that it is unsustainable to continue giving their cabbies preferential market protection while Dundee's cabbies are gonna ask their council to do just that.

Methinks that common sense is gonna prevail and Dundee cabbies are gonna have to wear market conditions just like every other commercial market sector.

Get used to it boys.
