So again I ask where exactly would you like the ph to sit whilst waiting for legitimate work to come through?

I can assure you that is not the case, even High Court Judges struggle to define plying.

There are 100s of different variables as to what is an aggravating factor, in respect of plying. A PH parked up on the road or high street isn't one of them.

Couldn't give a monkeys what Mr Fleming says, it's the blokes with the white wigs that matter, and even they aren't that confident on a proper definition.

It all depends on what the driver does and says, merely sitting in a PH on a high street isn't plying for hire.
