Don't believe he is a taxi driver at all.

Or maybe not that long which would explain his misunderstandings, inaccuracies and lack of any comprehension of CG(s) act.

Legality is of course a matter of opinion.

It has been posted here that the 'legal expert ' reporting to the Holyrood committee considers app use a Hail and not a booking.
I am informed one Authority in Scotland contests this and considers it a booking.
What they will do about it is unclear but I suppose they could try to ban drivers from using them.

Services that put the customer telephone call direct to the driver without a booking office was considered legal by the only opinion that matters the high court. Even though there is a central figure administrating, a booking office licence is not required.

Most apps provide the same service connecting passenger to customer and charging the driver for the service.

There is a slight difference with Get Taxi and Uber because that they take the payment from the customer and pass it to the driver after deducting commission of course.
These two are the current global players in the market and for them a booking office Licence would be a formality.
On average the fees for a licensed broom cupboard in all 32 Councils areas in Scotland would be less than £10 k a year.

The opinion of Scottish courts is yet to be sought.
