As far as I am concerned unless they are supplying a licensed taxi, the advert is misleading. They are advertising a service they can't provide.
Make a formal complaint to the PCO.

Or just email them and point out they are a PH firm not a Taxi and sit back and wait for the response

Asking the cab trade for money to form a fighting fund to take these firms to court wouldn't yield enough money to buy a big breakfast at the Oak.
Drivers would rather put a pound in the fruit machine than in a fighting fund.
This is why the trade representative bodies have to unite soon before it is just too late.
Its up to the members of these associations and the union to put pressure on their BOM.
The cab trade has a poor record in the courts and is reluctant to take on these issues. But if they don't do something soon, we will just be harmonised and disappear.

In London this issue should be sorted By TFL. It should not have to go to court.

Why is it illegal? Is it because they use the word Taxi when they are private hire

About sums it up.

A while back someone or some organisation took a PH (then minicab) firm in London to court, over them advertising on the Internet as offering a taxi service.

I think they were aiming at the international traveler market, and I suppose to those customers a taxi isn't always a taxi, just a vehicle that takes them from A to B for payment.

Anyway the advert was deemed to be not ok.

So is it relevant as to how many of your fleet are actually taxis? If you don't actually have any cars but you provide a service to find cars like www.cabfind.com is that legal? Bearing in mind that Cabfind is part of the Davy Liver Taxis group which again is a PH company so can they call themselves Taxis?

This is why, in London, we have to now go back to parliament as the private hire act of 1998 is not fit for purpose. it is full of holes.
Its time for us to put our hands in our pockets and get the lawyers involved.

To what purpose though?
