Driver is fined for smoking in vehicle


A taxi driver has become the first person in south Northamptonshire to be prosecuted under anti-smoking laws.

Valerie Dean, from Towcester, was fined £50 and ordered to pay £100 costs after pleading guilty to smoking in her taxi.

Mrs Dean had already been sent a warning letter and had paid two fixed penalty notices.

The ban on smoking in all enclosed public places and workplaces was introduced from April 1, 2007 and includes vehicles used for businesses.

Mrs Dean was witnessed smoking in her cab on July 21 and was eventually prosecuted at Towcester Magistrates' Court on Thursday, December 11.

Councillor Andrew Grant, portfolio holder for Safer and Stronger Communities, said: "Our approach to dealing with the smoke free laws has always been to raise awareness through education. Court action is a last resort. However, when a person continues to flout the law, we don't have many other options open to us other than to take formal legal proceedings.

"We wrote to all businesses to tell them how the smoke free law affected them."

The provisions of the Health Act 2006 aims to protect workers and the general public from the harmful effects of second-hand smoke by imposing a smoking ban in all enclosed public places and workplaces, which include vehicles such as taxis, work vehicles and all public transport.

All taxi and private hire vehicles are required to display appropriate smoke free signage.

Has it? The law is clear and she had been warned previously.

She was probably having a blonde moment and forgot about the warning letter and previous penalty notices :lol:
