Block Exemption Regulations (BER)

Dear Independent Garage,

You will be aware that the current Block Exemption Regulations (BER) are due to expire on May 2010 and as things stand, BER will not be renewed.

This will mean that vehicle manufacturers will no longer be obliged to release technical data and codes to independent garages.

You will therefore be prevented from servicing, maintaining or repairing and increasing number of vehicles and your customers will be forced to take your work to the main dealer.


The Right To Repair Campaign (R2RC) is fighting this battle on your behalf – both in Westminster and Brussels – and Euro Car Parts is helping to fund R2RC and the campaign.

The good news is that there is still time to influence the decision but TIME IS SHORT!

We need you to:

  1. Sign the online petition on www.r2rc.co.uk, and strongly encourage those of your staff who haven't signed it to do so now
  2. Display the R2RC literature (this will require a small contribution towards costs of Ł10.00 + VAT). Click Here to order these – PLEASE REMEMBER TO SUBMIT YOUR FULL DETAILS IN ORDER FOR US TO PROCESS YOUR ORDER
  3. Write to your company's MEPs and MP(s) - templates are on www.r2rc.co.uk
  4. Provide us, if you can, no later than 27 February, with evidence of abuse of the current BER.



Examples of abuse include:

warranty claims being refused because a vehicle has been serviced by an independent garage

commissioning codes needing to be re-set by a main dealer because information is not available to independents

technical information withheld by vehicle assemblers because of alleged connection to security information

publishers of diagnostic or technical information being offered reduced contract periods when current contracts expire

parts manufacturers being blocked from supplying the independent aftermarket by vehicle assemblers who insist on owning tooling or claiming proprietary rights.

Remember, if we act now, we can still influence the decision!

Yes. If the car manufacturers keep computer codes and data within their own dealer networks, the independent garages will be stuffed.

Yes. If the car manufacturers keep computer codes and data within their own dealer networks, the independent garages will be stuffed.


I was going to sign it but the link is broken eusasmiles.zip

It doesn't effect me to be honest cos I tend to deal with the main dealer but I think it is only right that there is a choice for everybody.

It still affects you. If main dealers have a monopoly, what is to stop them charging more? You won't have a choice but to pay them.
