Post subject:  Disabled taxi drivers have right to work

Pressure is growing on Dundee's lord provost to resign after his comments about disabled taxi drivers.Letters have appeared in the local press for Mr letford to resign. Below is two of the letters


John Letford should consider his position as chair of Dundee’s Licensing Committee following his comments suggesting disabled taxi drivers should consider getting another job.
Mr Letford made the comments at a committee meeting last week.
It amounts to discrimination against the disabled. Has he not seen the Government adverts that encourage employers to help and keep on disabled workers? The council should know better and be leading by example.
I too am a disabled taxi driver. Driving a taxi is my livelihood. It pays my rent, Council Tax, and helps feed my young family.
If I were not doing the taxis I would be at home living off benefits because I am limited in the work I can do after having an operation on my spine. TAXI DRIVER

I remind John Letford that the taxi driver’s cab is his place of work, so remember the law on the Health and Safety at Work Act.
A person must move or lift a wheelchair only if he thinks it is safe to do so. Another way to put it, if the person he/she is pushing up the ramp is bigger or heavier than can be moved, then he/she can refuse to take her/him on the grounds of Health and Safety at Work Act.

Also if no training on using wheelchairs has been given, you can refuse to take the wheelchair passenger on the grounds of health and safety.

Who does John Letford think he is? Surely it is time for the union to take a stand through the courts on this wheelchair action.

I have a wheelchair taxi and I will not take a wheelchair passenger if that person is bigger than me. They should use a tail lift taxi or minibus.

There is an NVQ module covering disability awareness training for bus drivers introduced by GoSkills (the Sector Skills Council for Passenger Transport).

It is clearly in the best interests of both the bus driver and the passenger if the driver is fully aware of the needs of his disabled passengers and how to respond to them.

However the regulations do allow the driver to refuse to help you if doing so would adversely affect his health or safety, your safety or that of other passengers or the safety of the vehicle. — Happyhighlander.

Not so.
In the Sneddon case, the council acted outwith their powers (ultra vires).
If The council lose that appeal, Couttie's case becomes meaningless because anyone will be able to licence whatever type vehicle they want.

I believe the council lost on reasonableness or an inflexible policy in the Couttie case.
(Although the Sheriff agreed with his renfrewshire colleague that a wav policy by the council was ultra vires)
Even if Sneddon's case is lost, the council's inflexible attitude could still get Mr Couttie his saloon.

txop gusmac is correct ,dundees flexible council rules ie (some get saloons,some get doblos ,others £20000 grand stuff make it a different case when it gets to court

More pressure on Mr letford another letter in todays press

I am a taxi driver/owner of a wheelchair accessible vehicle in Dundee.
In May 2003, I forgot to renew my licence due to ill health. Because of the Licensing Committee’s summer recess it was September before I was able to operate my taxi again, but as private hire.

The council decided my car was no longer suitable to be a yellow plate taxi despite it operating with this type of licence until May 2003, when I forgot to renew my licence.

I have since tried on two occasions to get my yellow plate back.

I have a medical condition with my knee but this did not prevent me from accepting wheelchair passengers as my car has a remote electric winch, which pulls the passenger in his wheelchair into the vehicle.

Private hire licence means I no longer have to accept wheelchair-bound passengers, due to licensing regulations, which are down to the Licensing Committee.

I always willingly accepted jobs from my office for wheelchair-bound passengers, but due to the Licensing Committee’s stance, disabled passengers in the city have lost a willing driver and vehicle, which now isn’t being operated to its full potential.

I attended a recent Licensing Committee meeting to put my case for my vehicle having its yellow plate reinstated, but this was turned down.

I asked Convener John Letford after the decision if I may ask a few questions on the decision. He replied NO

IF snp wins they will have 14 councilors they are hopeful that they will take control of the council with the help of independent councilor borthwick. This will put an end to Dundee's labour run council

SNP have given the trade a lot of support so maybe they would a least listen to what the trade are saying.The wav thing i think will be sorted out in the courts but they may well take a tougher stand against private hire.
