Applications must be dealt with within 6 months, but prior to that deadline expiring they can obtain a 6 month extension from a Sheriff, so effectively they have 12 months, the 'clarified' survey will be out before then I assume

thats one way of looking at it i suppose. :oops:
i like the way you presume they can ,almost as if gaining an extension is a forgone conclusion,it most definatly is not.
waiting for the results of a survey is a very poor excuse and its doubtfull that an extension to the 6 months would or indeed should be granted under those circumstances.

Practically two years to the day the Scottish court of appeal stated, "awaiting a survey of demand did not amount to a good reason for an extension of time" and that the decision to carry out a survey did not obstruct the council in any way shape or form from reaching a decision on whether to allow or deny the license application.

If anyone in this licensing area wishes to apply for a license and they think they can complete the six months licensing process before the new survey is adopted by the council, then they should follow their instincts.
