Post subject:  cabbie given fixed penalty for not wearing seatbelt
09.00 today Lincolnshire police decided to spend 15 minutes checking motorists for seat belt offences the only driver they pulled was a hackney Carriage driver on his way to the rank after dropping his last fare !

The penalty notice will be contested in court !

Any assistance from forum members with details of the specific clauses in the relevant acts of parliament to assist in putting together his defence would be appreciated

Exemptions from seat belt wearing

The legislation provides for a number of specific exemptions from the seat belt wearing requirements on medical and other grounds. Please consult your doctor if you think you should not wear a seat belt on medical grounds.
As for the others these include:-

"(b) the driver of or a passenger in a motor vehicle constructed or adapted for carrying goods, while on a journey which does not exceed 50 metres and which is undertaken for the purpose of delivering or collecting any thing;

(c) a person driving a vehicle while performing a manoeuvre which includes reversing;

(d) a qualified driver (within the meaning given by regulation 9 of the Motor Vehicles (Driving Licences) Regulations 1987) who is supervising the holder of a provisional licence (within the meaning of Part III of the Act) while that holder is performing a manoeuvre which includes reversing;

(e) a person by whom, as provided in the Motor Vehicles (Driving Licences) Regulations 1987, a test of competence to drive is being conducted and his wearing a seat belt would endanger himself or any other person;

(f) a person driving or riding in a vehicle while it is being used for fire brigade or police purposes or for carrying a person in lawful custody (a person who is being so carried being included in this exemption);

(g) the driver of—

(i) a licensed taxi while it is being used for seeking hire, or answering a call for hire, or carrying a passenger for hire, or

(ii) a private hire vehicle while it is being used to carry a passenger for hire;

(h) a person riding in a vehicle, being used under a trade licence, for the purpose of investigating or remedying a mechanical fault in the vehicle;

(j) a disabled person who is wearing a disabled person's belt; or

(k) a person riding in a vehicle while it is taking part in a procession organised by or on behalf of the Crown."

If the driver was a HC driver and within his own licensing area then he has nothing to fear, although the over zealous policeman will have :wink:

Tell him to go to the police station and ask to speak to the duty inspector, and inform him of the law even give him a copy of the link CC provided and that you want a written apology from the doughnuts that issued the ticket, and you want them reprimanded

I would just ask them to recind the ticket. Why go out to antagonise them, they may give the vehicle a close inspection next time and they may find something wrong.

Quite, but you would expect a trained Police Officer to at least know what is and what isn't breaking the law wouldn't you, or am I expecting too much again :lol:

he's got nothing to fear mate, I know a few round our way who got off with the same thing many years ago.

we had the same thing a few weeks ago. every ticket was ripped up. not sure if the officers were pulled up tho'.

At a recent York race meeting we asked the police to remove an out of town Private Hire Vehicle who was waiting on the hackney rank, he said he couldn't as it was a taxi when we pointed out it was not, and not from our area the reply was "there all taxis to me mate, get on with it"

If that happens again block it in and refuse to move, we did a transit van one night, the driver copped the needle and mounted the pavement and drove down it the full length of the rank giving himself a right pulse bubble to the head, and another driver whose no longer with us asked some woman politely to move who promptly told him to (edited by admin) off so he gouged her wing mirror off and remodelled her drivers door a bit for her while she was in somewhere having a drink, so I guess an old beat up WAV did have it's purposes :lol:

We jack them up and remove 2 wheels :D or call our mate with a pick up and he drops the vehicle off a few miles away outside a police station :lol: :lol:
