Interesting read, but hard to believe how daft some people are. An opportunity for a lottery system has, I believe been missed here. Three groups 1. Unite 2. Airport Taxi association 2. Stocktax (S Darlington) have all proposed a lottery system, in each case all request length of service as part of the criteria. All have read Employment tribunal no 2409542/07. Judge Porter presiding. In paragraph 23.33. Of this report Evans of the Unite union (1. above) recognizes that length of service disadvantages Asian drivers who have less than 10 years service. Yet he still asks for length of service to count now. So do the Airport taxi association. Stocktax ask for an extra ticket for each person in the lottery for each year of service. Laughable if it were not so important. Para 46.4 Judge Foster writes "Bearing in mind the historically male dominated profession there is an intrinsic risk that length of service puts or would put women at a significant disadvantage" Para 49. Judge Foster writes "The terms as to length of service were discriminatory" Para 50.2 Judge Foster writes "This is not a case where length of service is necessary of inherent value"....."It is difficult to understand how someone with 46 years as a driver would be better qualified in the job than some one with 10 years." The council has read this document from cover to cover so have their legal team (for whom you and I have been charged £155,670.88p. Council own figures for 08/09) for nearly £156 grand they should have told the council to avoid length of service as a criteria at all cost. This being the case the 3 groups mentioned above have already ruined the chance of a lottery solution, I believe. I have no time for Simms or TODA but at least they got it right. They ask for a lottery system of managed growth but leave it to the authority to work out the logistics. Well, we will find out next Tuesday 24, good luck everyone. |

Am I aghast the local unions/associations have got it wrong? Oh no. 
I think if Manchester do anything other delimiting, or issuing via a lottery, then they will be back in court. For what it's worth that report is written in such a way as to give the council a cast iron legal defence, should they delimit and be challenged in court. But I'm often wrong.

I dont think your wrong Sussex. On page ten they got to some length to stress over 50% of the 86 issue have already been sold. On page eleven they stress there is spare capacity at the Airport, so no need for ranks. This is clearly not true, but, I bet it helps to de-limit. |
