Post subject:  Discord over taxi drivers' music rights

PLAYING a little background music during a journey with a passenger, could mean taxi drivers hitting a sour note with the law.
Cabbies in Kirklees are to be reminded that they need a licence to have recorded music in their cars or taxi offices. And this would set firms back up to £99.

Members of the licensing committee agreed this week the rules should be made clear to everyone in the trade.

Legal officers produced a report saying UK copyright law requires anyone using recorded music in public to have a performing rights licence, which protects the rights of composers, lyricists and copyright owners.

If music is being played in a cab carrying fare-paying passengers, the taxi becomes a public transport vehicle and so subject to the law.

Principal legal officer Geoff Bell told the committee: "Taxis should have the licences and so should operators. The chances of the ruling bodies taking action are minimal but random checks are possible.
"I don't think the council should impose conditions. But we should advise firms they could be breaking the law."

Amjad Nadeem, vice-chairman of Kirklees Hackney Carriage Association, said: "We will make this clear in our training and recruitment programmes."

what a load of cobblers...99.999999% of Taxis or PH will just play it anyway.

Wouldnt it be a better Idea to have a licence to play music if the Expected audience is say 17 People or more..lets be honest,,your passengers are not there for a mobile concert of music but because the want transported somewhere..

what a bunch of Pillocks the PRS are, have they not got an ounce of common sense, they'll just alienate themselves further and end up with more people burning copies of a CD just to irk them more and end up losing money because of it.. :?

What the PRS want is for everyone to pay to listen to the radio and radio stations to pay to broadcast the music because the likes of mccartney elton john etc aren't earning as much from record sales these days all shops and self employed tradesmen have to have a license and it will come I.m sure to taxis next I know they were chasing us for ages saying I needed one for the office which is in my house even though i don't employ any staff !

They gave up in the end but I'm sure i read somewhere that limo company was successfully prosecuted for not having a license the law ISN'T on our side !

Actually no they don't have anything better to do, this IS their job!

What to tell us what the law is?

Will there be a report on paying Income Tax? National Insurance? VAT? Electricity Bills? Television License?

They get that now at the petrol pumps. The PRS is in force on buses, I've noticed a few buses round here with the blue PRS sign. I forget how much it is now for the year? When my mate used to own a pub it used to cost him £250 per year.

Now that's the best reason yet to refuse to play BOOM BOOM music when the pished up brigade are going home & say, "Can we have the radio on driv . . . . can you turn it up driv . . . . & then the cab starts rocking as you're driving because they're dancing in their seats & swaying to the music.

I think a figure of £99 per year was being quoted a while back and this covered a combined PRS and a couple of other licenses that they say that we need.
