Post subject:  Does the punishment fit the crime

A Dundee taxi driver has had his taxi drivers license taken of him for hiring someone else's plate.While i agree with the punishment i cannot figure out why a private hire driver at the same meeting was only giving a months suspension for getting caught picking up illegally for the second time.Surely the punishment should be more severe for the ph driver. :?

What would be the punishment in other areas :?:

I guess one was an offence in general...and one was an offence against the Council...and oooooooooooh they dont like that at all!!!

What insurance company will insure a phc as a taxi ?

If you can't name one then it is driving without insurance, and a criminal offence.

Gary , I am sure you will agree with me, if only on this one point.

If a vehicle is insured to be used for a purpose that requires a licence, then the insurance company will demand that that licence is held, or the insurance is not valid.

I seem to recall seeing on this forum a phc driver somewhere down south getting 8 points and the rest for this exact offence. If points are coming into it then local rules are not relevant. as you are into national laws if points are issued.

Frank, Hire and Reward insurance, is Hire and Reward insurance. I am not saying that you are wrong. I am merely pointing out that depending on the insurance criteria, there may not be a lot of difference between Taxi and Phc, pick up.

What would happen if the driver of a PH had hack insurance as opposed to PH
Has this ever been tested :?: all the PH driver has to tell his insurance is I need hack instead of PH, given that there is not much difference in price between the 2

oh there is a big differance between them skippy

iam sure if u tried to use a hack insurance policy on a PH that would make the policy invalid as u had lied when getting the policy and the insurance company would not pay out any claim and iam sure the cab office would spot it when u present your insurance forms at your cab test every year and would fail u asap for not having the correct insurance

the insurance has to be for what you are liceanced for pubs, hotels etc etc all have to have insurance that relates to there type of buisness.

these buggers are happy to take your dosh and when u claim they look for every loop hole to avoid paying out gits :lol:

chipper and Gusmac we have the same problem in Dundee but we have continuously battered the police,council and politicians with case law and info that is available on this forum . Don't get me wrong we have been at this for years now but I hope in the next few weeks all our hard work will have paid off.
The problem in Scotland is that we have not tackled the ph problem properly.But what you have to realize is the road traffic act covers the whole of Britain so why can the police in Liverpool prosecute a ph driver for driven without insurance when picking up illegally and the police in Dundee,Edinburgh,Glascow and Aberdeen cant.
