Serious issues surround Fenland Council's suspension of taxi drivers



SERIOUS issues surrounding the imposition of suspensions on two Fenland taxi drivers who have picked up six points on their licence, threatens to escalate simmering discontentment.

Fresh from a narrow defeat over the removal of taxis from the Horsefair in Wisbech, the mood of Fenland's drivers is not good.

Their spokesman Dave Patrick now seems likely to be a candidate in next month's by election in Wisbech North.

Mr Patrick describes the council as running a "kangaroo court" in its application and determination of licensing issues, and although the language may be colourful it is obvious a long running series of problems have not been adequately addressed.

Council Leader Alan Melton met taxi drivers' leaders this week and may be able to reconcile some of their grievances. But he also must be mindful of the need to stay clear of the quasi judicial deliberations of his council's licensing committee.

Whether Mr Patrick wins a seat on Fenland Council or not, he has clearly become a focal point of the taxi drivers' anxiety and it will be interesting to see how this single issue translates into a wider debate about accountability that undoubtedly will become the focus of his campaign.

Whether we agree or disagree with Mr Patrick doesn't matter but what we do applaud is his engagement with the electorate through the most revered channel possible - the ballot box.

6 points and you're unfit to be a cabby, oh and here's a little suspension to punish you further.

Someone should have asked them for their Threshold Criteria for the Fit and Proper Persons test before going into the meeting. My bet is they don't have one, how convenient is that?

So how does a council, define what is, a Fit and Proper Person? And how do you get a Fair Hearing?

Just for your information, lawyers don't normally challenge anything under Human Rights if they can help it. Most lawyers are not qualified to do so, and nor do they want to. Why kill the goose that lays the golden eggs?

Here in Scotland, The Civic Government (Scotland) Act 1982, is a dripping steak to these buffoons in the legal profession. They make pots of cash jumping taxi drivers through their hoops, while only representing their own financial interests. If you don't challenge these Kangaroo courts under Human Rights , nothing will change.

I understand a guy from this area is waiting for his appeal to the committee, his license expires shortly and the licensing department are refusing to issue him a new license prior to the hearing........which maybe a few weeks after expiry!

He should be scrutinizing council procedure and appealing under Human Rights. The council has no threshold criteria, no definition, and no appropriate procedure to determine how fit and proper a person is. Suspensions are not supposed to be used as further punishment. It is totally logical to suggest that someone is not a fit and proper person, and then to reinstate his licence at a later date, after a period of suspension. This is nothing but bully boy tactics.

I hope he takes them all the way, but challenge under the wrong legislation and you are fecked.
