Taxi driver smoking ban

A TAXI driver brought before a court for smoking in his cab told a judge that good had come out of it because he had stopped smoking. Gary Hutchence, 45, of Bamton Avenue, South Shore, admitted smoking in a smoke-free area.

He also pleaded guilty to driving a cab without insurance.
Hutchence was fined £310 with £150 costs and ordered to pay the £15 victims' surcharge by District Judge Jeff Brailsford sitting at Blackpool Magistrates' Court.

Victoria Cartmell, prosecuting for Blackpool Council, said a man who parked behind Hutchence's taxi in Layton saw him smoking in his cab on November 24 at 9.20am.

When spoken to by a council official Hutchence said: "I can't smoke, I have just had four teeth out." Inquiries revealed that between November 21 and 25 he had no insurance for his cab.

Hutchence told the judge: "Luckily, I have now given up. That's the good thing that has come out of this." He said he had sent off a cheque to pay for his cab insurance, but it was late because of a postal strike.
