Cab driver denies running over fare


FREDERICTON -- A Fredericton cab driver accused of running down a customer with his taxi denied the charge in provincial court yesterday. Benjamin H. Waugh, 57, pleaded not guilty to Dec. 5 charges of assault with a weapon and dangerous driving.

Police allege Waugh struck one of two passengers who he thought had tried to leave the car without giving him the cash he was owed for the fare.

Crown prosecutor William Corby told the court he isn't seeking convictions on both the assault and dangerous driving charges.

"They are alternative charges," he said.

That means if Waugh is found guilty, he can only be guilty of one of the two counts.

City police reported that Waugh dropped off two passengers around 1 a.m. on Dec. 5.

The passengers ran up a street with the taxi in pursuit, a police spokesman said.

The taxi driver turned into the alley and struck one of the two passengers, the police reported.

The man struck by the cab was taken to hospital with a leg injury and later released.

Police said the two passengers had left money in the taxi before they ran.
