 Post subject: hackneys on supermarkets

can anyone help with the problem that hackneys in my town are having For yrs private hire cars, who have the freephone in are local asda store were parked on the drop of pick up point at the front of the store. picking up people that had used the freephone and also picking up people who had not phone or pre-booked making it illegal, they have now been moved from the front. the asda manager invited the hackney trade to have 1 cab waiting at the front, and 2 at the back of the carpartk, are licencing officer as told us we are illegally parking as it is not an council approved rank, i pointed out neither was the station, he said thats totally different. i understand cause it has a through road, that dismisses the private land, but is that not just an issue for the highways

A taxi rank needs to be approved, whether that's on public or private land.

If your licensing rules state you can only wait on a rank, then that means you can't sit at ASDA until a taxi rank there is approved.

Doesn't surprise me at all.

But I believe they are wrong, and your LO is right.

Ask your LO on what legal basis they came to their view, and do likewise to Unite.

Then make your decision as to stay or go.

Its a class example of LO being chit scared of the big PH company.

PH return to base HC return to rank, ranks are never going to be big enough and LO can't or won't police the PH companies.....and with the the spending squeeze, its only going to get worse.

1.. are your Hackney's wheelchair accessible.
2. ask your licensing officer what authority he has over private land.
3. ask the store manager to ask for a hackney stand.
4. if your Hackney's are wheelchair accessible.... ask your L.O why he is discriminating against the disabled.

i been told this by a police officer. the car park is only treated as a road for certain sections of the traffic act ie insurance. road tax is not required on private property

It will be classed as a road under taxi acts.

we should get a decision tomorrow looked at that scampion case, very interesting read. also found this for a neighbouring borough. the bylaw that was being chucked at us by LO is no 7, requires when drivers when plying for hire in any st, and not actually hired to proceed to proceed to nearest available rank, but for bylaw no 7 there would be no restriction on plying for hire by driving around on the highway or (subjuect to landowner concents) standin on any land either as a single vehicle or with others or (subject to traffic regulation orders) Another part is on about private ranks. The expression of private ranks refers to ranks on private land, which have not been designated by the taxi licensing authority. These can typically be found in certain supermarket car parks, provided they are not on a street the use of them does not constitute a breach of bylaw 7
