Birkenhead cabbie accused of double rape of teen girl A TAXI driver raped a teenage girl twice after he picked her up following a night out, a court heard. Cabbie Neil Hayes, 46, is alleged to have attacked the 19-year-old after she had been out to celebrate her sister’s birthday in Birkenhead town centre. Liverpool Crown Court heard Hayes turned on the teenager after driving his private hire car into a quiet street off Ferry Road, near Eastham. Henry Riding, prosecuting, told jurors that Hayes forced the girl to perform a sex act on him, before raping her. He told how the girl jumped out of the car after her ordeal came to an end and was eventually found by a passing motorist in an extremely distressed state. Hayes, of Brook Street, Birkenhead, denies two counts of rape in the early hours of July 4. He admits picking up the teenager, but insists all the sexual activity was consensual and told officers the girl was enthusiastic about it. But Mr Riding told jurors that a doctor who examined the teenager after the alleged attack reported she had bleeding, swelling and bruising, indicative of “non-consensual sex”. Mr Riding told how at about 4am lockkeeper James Hogan was driving home when he came across the teenager. She was sobbing so much she was unable to tell him what had happened and Mr Hogan was so concerned he went and got his wife Marie out of bed to come to her aid. Sobbing teen tells jurors “I couldn’t move” during alleged cabbie rape A TEENAGER broke down as she relived to jurors how a taxi driver allegedly raped her twice. The 19-year-old woman wept as she told Liverpool Crown Court of the night cabbie Neil Hayes, 46, allegedly attacked her. Hayes, of Brook Street, Birkenhead, denies two counts of rape on July 4. The cabbie admits picking up the teenager in Birkenhead town centre in the early hours, but insists the sexual activity was consensual. Jurors yesterday watched a video interview taken just a day after the alleged incident when the girl sobbed as she described how Hayes pulled up in a quiet road, near Eastham, and forced her to perform a sexual act on him. She told how he then raped her in his private hire car. The girl said: “I was just scared. It hurt, but he just carried on. I'm curious about this and the remand in custody of Mr Hayes. Is it the norm to remand those accused of rape? |

What DNA according to his testimony they never had intercourse. Why would he run away again according to his testimony it was consentual |

well for 1, is her DNA in the front AND the back? (or any identifiable clothing fibres, etc) DNA is left behind off everything we touch, nor just body fluids |

He turned off his radio because he was pirating and not for any other reason, that's what they do when they pirate. Isn't this his 2nd trial because the jury from the first trial couldn't come to a verdict? |

Birkenhead taxi driver cleared of raping teenage passenger A TAXI driver was cleared of raping a teenager twice after picking her up following a night out. Jurors took about four hours to find Neil Hayes, 46, not guilty of attacking the 19-year-old girl in his private hire car. The teenager had been out in Birkenhead celebrating her sister’s birthday when Hayes picked her up in Conway Street. Hayes, of Brook Street, Birkenhead, admitted collecting the teen, but he denied two counts of rape in the early hours of July 4. He told jurors all the sexual activity between them was consensual after he pulled up in a secluded location off the A41. Hayes told the court he had indulged the teenager after she made a pass him, adding that she had initiated the sexual contact between them. Guilty of not being 'fit and proper' though. Perhaps our council will do as some others have and advise drivers that it is 'not fit & proper' to indulge oneself in the back of their vehicle
