Two-week licence ban for cabbie who breached laws

A cabbie who repeatedly broke traffic laws in Torquay has had his council-issued operating license suspended for a second time.

Keith Dooley (pictured), of Paignton, a Hackney carriage driver, appeared before a Torbay Council licensing sub-committee and was suspended for 14 days, a week less than the length of time for which a council officer was asking.

The committee heard it was the second time Dooley faced a suspension threat. In April last year his licence was suspended for a week for similar offences.

Councillors considered the issues for 12 minutes before deciding a 14-day ban was more appropriate than three weeks.

They said they were satisfied three breaches of parking rules at taxi ranks and making illegal U-turns, all within five months, made him no longer a fit and proper person to hold a Hackney carriage licence.

However, in deciding on a shorter ban they said there was no evidence anyone had been put at risk by Dooley and they accepted his remorse and apology.

Council licensing chief Steve Cox, who recommended a three week ban, said: "It is part of an ongoing problem with Hackney carriage drivers not complying with road traffic orders."

He said drivers have been warned repeatedly since 2008 but between October last year and January this year Dooley's cab was three times seen overhanging the rear of the rank at the Strand, and making illegal U-turns from the rank.

Mr Cox said: "He is not the only person doing it and not everybody gets caught, and it is important to stress that."

Dooley apologised and said: "I am guilty of pulling on the end of the rank, thinking a driver picking up a fare would pull off immediately and have been left stranded."

He said he was not aware that making a U-turn at the rank was illegal as there were no signs banning the manoeuvre.

He assured the committee he would not do it again and would give no cause in the future for him to appear again before them for rule breaking.

He said he is now working in Brixham and only goes to Torquay on a Saturday night.

Mr Cox said: "You need to take into consideration that he has been here before and there are other drivers out there who watch what is going on."

No I don't think so this time Midlander.

He will have three weeks to consider an appeal to Magistrates during which he can work.

If he lodges an appeal he can continue to work until the appeal is decided.

I don't think section 52 came into it.

But, I could be wrong.

He's either fit and proper or he isn't. If he's not, what makes him fit and proper 2 weeks later?
This makes no sense at all. Another Kangaroo court assuming powers it doesn't have.

They are there to decide if this guy is fit and proper to hold a licence. Nothing more. He is either fit and proper or he isn't.
Punishing him for any perceived misdemeanor is not their function.

They assume the power of suspension which they don't have.
Then they use it as punishment which they are not allowed to do.
They have stepped beyond the scope of their powers, that makes them a kangaroo court.

Now you explain how someone can be deemed unfit for a fixed period of 14 days and fit again afterwards? It isn't logical.
