Does anyone know the potential penalties a local authority could face for not providing a Statement of Reasons within the time limit set out in the Civic Gov Act ? The Act states 10 days, but mine took 12/13 days. The reasons letter was asked for following a taxi application refusal |

theirs a complaint procedure im sure but whether these government bodies have any real affect is debatable. if its only a few days late i doubt whether it would even be taken seriously at all when were you heard and what did they say the reason for refusal was in the letter

You could go to the Council Ombudsman, but I doubt they would consider a couple of day's overdue a big deal. The council would simply spin them a line of acceptable bullshit. The Ombudsman is jobs for the boys' operation anyway, a bit like buying a bull terrier with rubber teeth, its barks a lot worse than its bite. Oh and incidentally, if your case is subject to a possible court action, the Ombudsman won't touch it with a barge pole, even if the council is found to be a parcel of rogues.

Was it dated out of time or received out of time? Also is that 10 working days or not? There's always a procedure for complaints against the council but as everybody points out it appears the councils in Scotland and a lot of the places in England don't take much notice of procedure anyway. |

1 Plate refusal and counting  Just 20+ to go We didn't even have to fight them on the beaches If your application was not one of the appeals plates i apologise The reason of 2-3 day's could be excused  SKULL and ALIT are right on that ONE

So you don't know if your right or i'm right according to your post, and i have already admitted i may be wrong  1 down and counting The council will not grant outwith of a SUD, if they do the Trade is waiting to pounce but they won't as i told you 2 mango's ages ago

Dougie, at least twenty plates are being granted on top of those issued off the IPL. There is no dispute about this. Oh and your “trade” is impotent to stop it. Now why don't you give yourself a shake and stop embarrassing yourself.

Heard it all before Skull lol believe it when I see it, carry on believing its all you have to think about, god help you when its all over lol. Skull a Deemed grant is when the council through a SUD deem the granting of licence subject to the Suds recommendations. Skull you are responsible for filling the heads of. You made that up didn't you Dougie? Dougie, a deemed grant by a sheriff means that unless the council appeal to a higher court the licence is granted. It has absolutely nothing to do with a survey of demand.

Our writ of appeal was submitted without having received the statement of reasons from the council. Under the rules, the sgtatement should be available to allow an appeal to be made. They did eventually catch up, and provided one, arounbd 7 months late. Something to do with pressure of work. No point in making a fuss about it. Just another point to be made when we get into court. |

are you seriously still in denial about this Dougie. the council lost its case the council appealed they then abandoned the appeal(because they had nothing by the way) they are now recalling the sisted (frozen)cases back into court and they are to be granted by the court,the council has nothing to do with this process Dougie apart from a joint motion to recall. cant you get it through your head what a deemed grant is,do you have any idea how stupid you sound when you make these ignorant sweeping statements.  your a clown Dougie simple as that |

The statement of reasons was requested on the 29th of September and it one dated the 11th October was received on the 12th According to the Civic Gov Act, "page 110, chapter 45, Sch. 1, 'Notifications of decisions and giving of reasons' 17. (1) " a licensing authority has to give reasons within 10 days of being required to, but unfortunately the law has been poorly drafted and I can see no penalty being provided for if a licensing authority fails to abide to that requirement http://www.legislation.gov.uk/ukpga/1982/45/pdfs/ukpga_19820045_en.pdf |
