A taxi driver attacked a customer with a metal shovel during a row at a railway station taxi rank.

Hassan Mir, 34, avoided a jail sentence for assaulting Daniel Womack at Wakefield Westgate station. But a court heard the driver was now out of work because of the incident.

Mir, a father of three, left Mr Womack with a cut lip after hitting him in the face with the weapon. He also struck him across his back.

Stuart Young, prosecuting, told Leeds Crown Court the incident happened at 4.30am on July 31 this year after Mr Womack was refused a taxi as he had no money. He asked drivers to take him home via a cash machine but was still told no one would take him and began arguing.

As Mr Womack stood talking to his friends he was struck three times by Mir who then drove off.

Mr Womack gave a statement claiming the assault was unprovoked. His friend, Tom Parkinson, said the drivers were being “cocky” and he tried to calm the situation as more drivers were arriving at the scene.

Taxi office worker Assad Malik told police he did not see the attack but had earlier heard Mr Womack shouting racial abuse at Mir.

Mir, of Duke of York Street, Wakefield, was later arrested.

He initially denied the attack but later said he did it after being racially abused. He pleaded guilty to assault occasioning actual bodily harm.

Abdul Iqbal, for Mir, said: “There is no sensible explanation why a man aged 34 years old, working in the middle of the night in lawful employment would behave in this inexcusable way unless there was some level of provocation.

“That is supported by a prosecution witness. It cannot in any way excuse his behaviour but it goes a long way to explain why.”

Mr Iqbal said Mir was now on benefits after losing his licence because of the assault.

Judge Jennifer Kershaw made Mir the subject of a 12-month community order and ordered him to do 150 hours unpaid work.

She said she believed Mir acted after being provoked, but added: “Unfortunately your response to this disagreeable situation was to arm yourself with a small metal shovel and set about the young man with it.”

I've heard of many things drivers keep in their motors for protection.

But where the f*** did he hide his shovel? :?

I cannot believe all the drivers would refuse to take him via a cashpoint or is there more to this than the report says ?


I bet he wishes the shovel hadn't been in his car now !

I have an AA Shovel in both my Motors....the Police and Council recommend such things for winter driving conditions....Its A dinky wee thing but would give a fair old skud around the lug if it were to be wielded for the wrong purposes...
