Overloaded PH driver 'unaware' all his children were in car




A cab driver caught on his mobile phone and carrying too many passengers in his vehicle has admitted it was a mistake.

Balal Shah, 36, of Old Ford End Road, Bedford was driving his private hire vehicle along Cauldwell Street at 2pm when police spotted he was holding a mobile phone to his ear.

They found Shah was carrying five passengers in a vehicle only licensed to carry four.

On Tuesday, Shah, representing himself, told Bedford Magistrates’ Court that he was carrying his wife and four children, not a fare, that afternoon.

He claimed he was not aware that all his children were in the car.

He said: ”I have only recently set up my private hire business. It was a one-off incident where I had left my bluetooth headset at the office and they were calling to let me know.

“I am very embarrassed for my behaviour.” Shah pleaded guilty to using a handheld mobile phone while driving, carrying too many passengers and to obstructing a constable in execution of duty on September 25.

He was fined £295 and given three points on his licence.

The fact that it was licensed for 4 means just that.

If he wasn't working for hire and reward he can't be prosecuted for a licensing offence.

If you took that view then he must put the meter on when taking his family out.

I know it's always a licensed vehicle, but there are some licensing conditions that only apply when you have punters on, the other laws are non licensing laws.

Say a driver was taking his family to the cinema, if he didn't go the direct route would he be charged with a licensing condition offence? Same if he didn't wear his badge.

Private hire, no meter

If the driver needs a badge even when its not working all regs must apply too?
