Off-road cabbie wins appeal



A LANCASTER taxi driver who had his licence revoked by the city council is now back on the road following a ruling by a district judge.


Andy Kay, from Carnforth, made two separate appeals against the suspension and then the revocation of his Hackney Carriage Licence by Lancaster City Council’s Licensing Committee.


City council barrister Charles Holland told Lancaster Magistrates Court that Mr Kay “had a problem with authority”, was “a danger to the public” and was not a fit and proper person to drive a taxi.


District Judge Jeff Brailsford dismissed Mr Kay’s appeal against the suspension, but said the decision to subsequently revoke his licence “was the wrong one, reached by the wrong route”.


Mr Kay, who is chairman of the Lancaster City Hackney Proprieter’s Assocation (HPA), first appeared before the committee on March 31 2011, after he visited the home of taxi proprieter Michelle Rogers, who is licensed by South Lakeland District Council.

so obviously we need the back issue of the paper for the story but it does have a ring about it of someones nose out of joint and retaliatory action !

He's certainly had one or two run ins with the council, but no more than the average trade rep, I suppose.

However, there could be a lot more to it than this, and if you get on the wrong side of authority they can often have it in for you.

Intriguing comment in the article about that home visit though :shock:

If I was to guess I would say the DJ said spending the driver during the early stages of this issue was legal, but they revoked his license illegally.

Maybe they just didn't give it back to him, hence the license was revoked indirectly.

But the whole story has a hundred questions for every statement in that article.
