It's because he was on the phone, had he not been on the dog he might have had time to react,

This is a perfect example of how the law fails to get people to stay on the pavement, since it became trendy to challenge a car deliberately it's got to epidemic proportion's, everybody thinks they have the right, and to a degree they have because ppl came before cars, but it's easier to stop a human moving than it is a car, so we end up with common sense getting ignored in favour of who came first, and no doubt between getting back from war and the lax ways of road disclipline all helped get this lad killed, and the phone of course, the really crap factor is it's one of the better people that got killed.

Having had a Drink and then walking down the Middle of the road would't have helped any. Yes the Driver was wrong to be on the Phone, but it Still was accidental.
