Although smoking had been prohibited in taxi and private hire vehicles since July 2007 Members believed that the Driver’s Guidance Notes and Code of Practice needed more clarity for drivers regarding the use of electronic cigarettes. Members discussed amending the Code of Practice and Drivers Guidance Notes in relation to the smoking of electronic cigarettes in licensed vehicles. * Resolved that: (1) the Code of Practice for Hackney Carriage and Private Hire Drivers in relation to smoking in a Licensed Hackney Carriage or Private Hire Vehicle be amended to encompass a wider ban on any form of smoking in licensed vehicles to include the use of electronic cigarettes or any other cigarette substitute which may be perceived to appear as a cigarette; and LICENSING AND ENVIRONMENTAL PROTECTION COMMITTEE (2) the Licensing and Land Charges Manager be authorised to forward a circular to all Hackney Carriage and Private Hire Operators advising of the policy change on behalf of this Committee. point 101 here http://moderngov.sthelens.gov.uk/ieListDocuments.aspx?CId=117&MId=2208&Ver=4 |

Surely if a licensing department bans e-cigs in private hire and black cabs then it would there duty to respond in the same fashion for the other side of there licensing duties namely pubs ?
