A taxi driver has been charged with false imprisonment and causing actual bodily harm.

Mohammed Afzal, 42, of Iffley Road, East Oxford, appeared in Oxford Crown Court yesterday over the alleged incident relating to two females on October 28 in Donnington Bridge Road, South Oxford.

He was released on bail and until a plea and case management hearing on August 16.

How does "False" Imprisonment differ to Genuine Imprisonment, If your being held captive against your will then its not really false.

If you imprison someone, if it's not legal it's false.

yup oxford the city of dreaming spires!!!

anyway the real story is he picked up some cheap skate women who would have been better calling one of the cheap PH companies more suitable to their level, the cheap skate women started to cry about the fare, and make a scene, driver hits the brakes, cheap skate women hit the back screen and break there face or something, he takes them to hospital and reports it to the plods.

anyway two weeks later, the cab is taken away for forensics, cheap skate women were claiming that the driver locked them in the cab - the locks dont work on this particular cab.

since then the driver has been of work for over 6 months, cant imagine how much he's lost in earnings.

To my way of thinking; I would say that if you were bringing in the perpetrators of a criminal act i.e failing to pay a fare after going the distance ( which is a criminal act ) back to the cop shop - then you are apprehending criminals. Store detectives/security staff do it, so I cannot see the difference. However, if violence has been used, then you are looking at a different scenario, again counteracted by using the defence of "reasonable force" in order to apprehend.

Just how far do they the "Prosecutors" push this type of prosecution - do we let the "Bank Robber" go in case he/she brings a case against a member of the public for false imprisonment.

To eradicate the problem it really does need testing in a court.

Doesn't account for the ABH charge.

Sounds more like passengers thought there was a nice little compensation claim coming their way but first there has to be an actual conviction of the driver. The thing is though that if he has genuinely caused their injuries he is in the wrong

If the customer hasn't put the seat belt, it's not really your responsibility is it? I mean you could point it out to them, I can't understand what they were doing so close to the screen?

As for false imprisonment, he was taking them to the hospital, no doubt concerned that something bad may be coming out of all this.

They may have been sitting on the back seat but when the brakes were applied, the passenger could have been flung forward at a great rate. as for false imprisonment, If the driver was taking the passenger anywhere that they didn't want to go, that is false imprisonment. You can't simply take a passenger somewhere if they don't want to go. If you are taking them to a police station because they aren't going to pay, you must first make a citizens arrest correctly.

You're right as well mr grandad, but as some would say CCTV would have sorted it out a long time ago.

Indeed, and I'm dealing with a few buffoons down here who still don't get it.
