Taxi driver loses licence following Torquay assault A TAXI driver has lost his licence following a physical assault in Torquay. Imran Nasim’s licence was revoked with immediate effect by Torbay Council’s licensing sub committee on Thursday. The committee heard that Mr Nasim punched another taxi driver, James Nicholson, in the face at around 3.10am on November 3 at the taxi rank on The Strand. There was a stand-off between the two drivers in Princess Road, Torquay, over who should reverse to allow the other vehicle to pass earlier that morning, and a series of further incidents which resulted in Mr Nasim getting out of his vehicle, approaching Mr Nicholson who was sitting in his vehicle, and physically assaulting Mr Nicholson. A taxi marshal pinned Mr Nasim to the floor and was subsequently assisted by a second marshal while the police were called. The assault was witnessed by an off-duty council employee and recorded on CCTV. The recording was shown to the licensing sub committee at its meeting on Thursday. Both drivers were present at the meeting. The committee heard that there had been ‘issues’ between the two drivers for around a year. When Cllr Vic Ellery asked what had started this, Mr Nicholson said he did not know, and Mr Nasim said it was Mr Nicholson’s ‘driving manner’. Veera Thakur, representing Mr Nasim, asked the committee to take the circumstances leading to the assault into consideration. She said Mr Nicholson had used a ‘racist remark’ which had provoked Mr Nasim. Committee chairman Cllr Pete Addis asked Mr Nicholson if he had used the word he was accused of using, and he said he had not. Ms Thakur also referred to ‘unwritten rules’ between taxi drivers but Cllr Addis said the committee was not concerned about unwritten laws. The committee heard that Mr Nasim was cautioned by the police but he failed to report this to Torbay Council as required by the terms of his licence. Mr Nasim said he was not aware of this obligation, even when the relevant statement in the taxi drivers’ handbook was pointed out to him by the committee. Mr Nasim had come to the attention of the council’s licensing team and licensing sub committee on a number of previous occasions due to incidents of ‘unacceptable conduct’. His licence was suspended for seven days in December 2010 due to parking offences and for four weeks in August this year due to an incident involving a civil parking enforcement officer. He also received a final warning letter about further parking issues and allegations of overcharging customers. Cllr Addis said to Mr Nasim: “When you last came before us, you received a one-month ban. You were advised to take an anger management course. Did you do that?” Mr Nasim said he did not. The committee spent nearly half an hour deliberating over a decision in private. Mr Nasim was then told his licence was being revoked and he would receive a letter in due course to explain the committee’s reasons.
