Drivers still waiting for taxi licences

Delays in processing background checks on Scarborough taxi drivers means a handful of them are still unable to get behind the wheel of their cab, months after they were submitted.

In total, eight drivers are still unable to take their taxis out as they await the results of compulsory criminal record checks as part of their applications.

But while temporary licences were granted to many drivers, due to the lateness of their application, others have, for the moment at least, been forced to put the brakes on their careers.

In a report that went before full council on Monday, Cllr Bill Chatt said: “I mentioned certain issues around the current round of Taxi and Private Hire driver licensing.

“As public safety is paramount each application is subject to a criminal records check; the delay in these being processed by other agencies had led to some drivers not receiving their licence before the existing one expired. I would like to update members that good progress has been made in licensing drivers, however there are still a handful still outstanding.”

Scarborough Council says that all eight were latecomers and as a result didn’t qualify for the self-declaration option.

As a result, all of them haven’t been permitted to drive and won’t be able to do so until their checks come back clear and the licences are issued.

The backlog has been caused due to changes in the Protection of Freedom Act earlier in the year, which has caused a national pile-up in the police processing what used to be known as CRB checks.

Drivers who applied before the self-declaration deadline on August 31 were handed a temporary licence, despite a possible criminal history that would ultimately take them off the road.

Can't believe you think the old system is worse than the new one.

The new system allows for no more paperwork to be filled in ever, and that includes people who need to be checked by different organisations.

Would you sooner fill in numerous forms for ever? :sad:

That isn't what our council think in their new policy.

3.6 Disclosure and Barring Service Disclosures

These will be at the level of Enhanced Disclosures as these include details of spent convictions and police cautions. These will be obtained every three years in line with Department of Transport guidelines. Drivers are obliged to report to the Council any new convictions.

The Rehabilitation of Offenders Act 1974 has been amended to exclude Taxi Drivers; therefore applicants are required to disclose all convictions cautions and prosecutions, endorsements and fixed penalty notices.

Disclosure and Barring Service reports serve to confirm details provided by an applicant on the applications form. Any discrepancy between the offences an applicant lists on their application form and those confirmed by the DBS will be seen as a serious issue and could result in the application being referred to the Licensing Committee for consideration.

In the case of an overseas applicant where it is not possible to obtain an enhanced disclosure from the Disclosure and Barring Service, a Certificate of Good Conduct must be provided from the relevant embassy or legation. The applicant will be responsible for any translation costs.

No Disclosure and Barring Service report from any other Authority will be accepted. This Council is a registered DBS body and has a robust system for checking applicants and their documentation and only checks made by this council will be accepted.

Drivers are encouraged to subscribe to the DBS Update Service. This means that, with the Driver’s permission, instant checks can be done and there will be no need for further DBS check every three years.

The Council is bound by rules of confidentiality, and will not divulge information obtained by third parties. Applicants will receive the report and must bring it into the Council for verification.

In line with Department of Transport guidance this Council will consider each case on its own merits but a particularly cautious view will be taken of any convictions relating to dishonesty, violence, racial incidents and especially sexual attack. See the Guidance Relating to Convictions, Cautions and Prosecutions at Appendix B(2).

They clearly don't understand the new system. The point of the new system is so you don't have to get a new check with each council ect,and that the driver is the only one to get the DBS check, and that it will be the driver who shows it to the council. The council then with the drivers permission will be able to see the drivers record online and so long as you keep your payment up to date you won't need another one.the mr t case means you don't have to declare spent convictions,it against article 3 human rights act.

I've been to renew my badge today, £133 for the year. We've still got to have yearly DBS checks, the Council have no idea what I was talking about when I said you can do it over the internet.

The new DBS will wipe clean any minor conviction which you've not been to prison for.

Am I meant to be surprised that many councils haven't got a f***ing clue about this new process?

If so I'm not.

The new process is a massive step forward.
