A man ended up losing his job, being banned from driving and being fined almost £1,500 after a lying taxi driver who set off speed cameras picked a name and date of birth at random which happened to match his details.

Andrew Gorman, 46, perverted the course of justice on two occasions by making up the name of a random driver, Plymouth Crown Court was told. (Friday May 16).

The court heard how Gorman, of Commercial Road, Hayle, was captured twice by speed cameras in Redruth, driving a Mercedes Vito van on August 4 and 5 2012.

Nigel Hall, for the Crown Prosecution Service, said on returning a form to Peninsula Road Safety Partnership in Plymouth, Gorman on both occasions gave the name and birth date of Martin Wright as the driver of the vehicle. He also provided two different addresses from the Greater Manchester area, the first in Dukinfield and the second in Oldham.

The court heard that police traced a Martin Wright with the same birth date. In the man’s abscence he was found guilty of both speeding offences and disqualified from driving. He was also fined £1,440.

Mr Hall said, as a result of the offences, Mr Wright was also sacked by his employer, a scaffolding company, at the time.

Edward Bailey, defending Gorman, told the court that Gorman bought his own taxi firm in April of this year and employed eight drivers. He was also a regular driver for Cornwall Council, transporting disabled children around the county.

Judge Philip Wassall said: “This is a consequence you should have expected.

“The consequences went on to seriously affect the life of an innocent member of the public. He was involved in a fight to clear his name for something you chose to do.”

Judge Wassall added that the offences “go to the heart of justice.”

Mr Gorman was sentenced to a total of eight months in prison and a 6 month driving ban. He is also required to pay a victim surcharge of £100.

What's to stop anyone stealing the number plates off your car, taxi, phc, or simply making up new plates and sticking them on the same make and model of vehicle and flashing every speed camera in town? :shock: It doesn't take much ingenuity to have someone's licence removed by deception. :shock: Oh and you would have one hell of a job trying to prove that it wasn't you doing the driving, or that it was your car in the photo. :shock:

Okay, this guy was trying to cover his ass but the speed camera and traffic light system of photographing vehicles is hardly infallible. :shock:

I've been involved with the police when they have tried to pull CCTV images from cameras and getting a clean image of someone driving a car, is not easy. :-|

And as for friends confirming, you weren't working, I doubt that very much, unless, they were absolutely certain, they were with you when the alleged incident had taken place. You are going up against photo graphic evidence, pointing to the fact that your friends are lying. :shock:

Oh and let's just say, I chose to use your plates while you were out driving, along routes you regularly travel. You'd be hard pushed to produce any credible evidence whatsoever, let alone, witnesses or CCTV in your defence. :-|

The fact that the incidents happened in Cornwall and the chap that got done comes from Manchester may have made it easier to prove that it wasn't him. I would assume that the chap from Manchester received a court summons? If so, why did he not contact the courts at that time?

He might have moved houses and the chap who got the points paid a subscription fee to 192.com did a search for names like his miles away. It's easy to do nowadays if 192.com's records are kept up to date.

The name was nothing like his. His name was Andrew Gorman and the other name was Martin Wright. Also the police didn't find Martin Wright from any address. They found him by the date of birth.

So the police are also at fault for picking someone with the same name from out of the ether and deciding to prosecute him.

I would guess that the police sent the summons and when they heard nothing back the case went to court.

Quite likely. this shows the slackness of the police in checking whether a person actually exists! Do away with speed cameras and all these problems go away.

What it shows, is that, if your name appears on the docket, anything you claim in your defence, will fall on deaf ears, until such time as you have the evidence to prove otherwise. In the meantime, you will be banned from driving and face the prospect of losing your job. :-|

Symptomatic of our modern Justice system...Guilty until proven innocent and not innocent until proven guilty as it used to be.

Does not look good on the Police this sort of thing.. :roll:

You are assuming that the chap didn't receive a summons. If he received the summons and ignored it because he knew it wasn't him, then he was a fool.
