Taxi driver Rofiqul Khan denies causing serious injury by dangerous driving after Robert Johnson was seriously hurt in Station Road, Ashford



A man suffered serious head injuries when he was dragged along a road in Ashford after his hand became caught on the door handle of a taxi, a court has been told.

Robert Johnson, from Maidstone, was badly hurt in the accident after he lost his balance, fell and the taxi ran him over, Martin Yale, prosecuting, told a jury at Canterbury Crown Court.

The taxi driver, Rofiqul Khan, 32, of Hurst Road, Kennington, Ashford, has denied causing serious injury by dangerous driving on December 22, 2012.

Mr Yale said at about 5am on that day Khan picked up a fare in Ashford High Street and two brothers got into the back of the taxi. It was dark and heavy rain was falling.

Soon after setting off the taxi turned into Station Road.

Mr Johnson, who had been out drinking with a friend, was walking in the middle of the road and approaching cars as they came along.

"A witness said Mr Johnson ran along the side of the taxi, lost his balance and fell over and suffered severe head injuries” - Prosecutor Martin Yale

“As the taxi arrived Mr Johnson took hold of the rear passenger door,” Mr Yale said.

“It was a sliding door and he pulled the handle but it was locked. Khan and Mr Johnson had some conversation.

"Khan was frustrated and accelerated hard along the road. Mr Johnson’s hand was still on the door.

“It may be that it was stuck and he couldn’t free his hand.

A witness said Mr Johnson ran along the side of the taxi, lost his balance and fell over and suffered severe head injuries.”

Khan drove a few yards, stopped and rang the emergency services. He was given a breath test which was negative.

A police officer examined the taxi and found it was possible for a hand to become trapped in the door handle.

Mr Yale told the court: “It was apparent that an adult holding the door would be visible in the driver’s rear view mirror.

Khan says when he first saw Mr Johnson he was in the middle of his lane, trying to flag him down.

“Khan said that he was concerned about his safety and the safety of his passengers.

“The crown’s case is that Khan showed a disregard for Mr Johnson and that by accelerating when he knew Mr Johnson was hanging on the car he knew he would sustain serious injuries. Driving in this way would be dangerous.”

The trial continues.

up thug forcibly stops a cab.......driver realises thug is trying to force his way in......driver fearing for safety drives off.....thugs brain does not en
gage to let go......lets blame the driver :sad:

FFS.......so because it could have become trapped then it must have been trapped, even though it was most unlikely that that could happen.

Feck sake...you could trap yer hand anywhere, between lavvy seat and base, yer zip, your Dogs lead, a passing bicycles spokes.....but that does not mean it actually happened.

Being pi55ed is the obvious and likely cause of this kind of incident..yet they ignore the obvious and focus on the feckin unlikely.

About 20 years ago one of the lads down here drove over a person who thought it would be clever to lay in the street.

If that copper had investigated that incident no doubt he would have confirmed to the court that a car wheel going at 30mph does indeed squash your head should you lay down in front of it.

Ex-Ashford cabbie Rofiqul Khan cleared of badly injuring Maidstone man Robert Johnson after he caught hand in door in Station Road



A former Ashford cabbie has been cleared of injuring a man in a road accident three days before Christmas 2012.

Rofiqul Khan, 32, had been accused of causing injury after driving his Fiat Scudo dangerously when Robert Johnson, from Maidstone, caught his hand in the cab door in Station Road.

Canterbury Crown Court heard how Mr Johnson was dragged along the road until he lost his balance and fell under the taxi's wheels.

He has now been left wheelchair-bound and is “profoundly physically disabled” and because of a brain injury is unlikely ever to make a full recovery.

Doctors discovered that part of his brain had been broken into tiny pieces and his injuries were such that in March last year he was transferred to a medical centre in Hildenborough.

Prosecutor Martin Yale told the jury that: “Mr Johnson was diagnosed with a traumatic brain injury and in March last year was in a permanent vegetative state, unable to communicate or respond to verbal commands.

“His condition in March was stable but he was non-responsive to any verbal or painful stimulus.

"His brain injury is described as ‘very severe’ and his prognosis ‘poor’.

“He was deemed unlikely to regain full level of consciousness and even if he recovers it was expected that he would be left profoundly disabled.”

Eight months later doctors reported his level of consciousness had “improved considerably” but he is unlikely to ever be able to care for himself independently.

The prosecutor said: “Mr Johnson was now conscious and able to respond to verbal commands.

"However, he is partially sighted and unable to stand or walk independently.”

Khan, of Hurst Road, Kennington, had denied the charge and said he had picked up two brothers, Daniel and Matthew Moss, in the early hours of the morning to take them to Stanhope.

As he turned into Station Road, Mr Johnson, who had been with a friend in Dover on the evening of December 21 drinking and taking cocaine, suddenly appeared in the road and tried to wave him down.

The taxi driver told the jury: "This man was trying to stop me with both hands. I said to him on three occasions that I had passengers.

"It was very frustrating what to do because he wasn't listening to me. He kept pulling the handle.

"I didn't know what to do. I then checked my mirrors and just pulled away. I was moving slowly."

The prosecution alleged that Mr Johnson’s hand became stuck in the sliding door and was carried along as Mr Khan accelerated away.

But the cabbie told the jury that he didn’t see Mr Johnson in his side mirror and assumed he had gone away.

It was only when he went over a bump in the road that he stopped – and was later told his vehicle had run over Mr Johnson.

"After a short while I felt something underneath my tyres. It felt as if I was going over something like a bump."

He said he stopped a short while later and saw a body lying in the road and made two 999 calls.

After the jury’s verdict, Khan was fined £500 and given three penalty points on his driver’s licence after admitting two charges of having defective tyres.

I think the right decision was arrived at.

As for the aggrieved, as is seriously ill I will leave it at that. :-#
