Post subject:  exemption certificates
Hi is there any local authorities in scotland that issue exemption certificates under section 166 of the equility act- section 166 was commenced in 2010- dundee city council say that this does not apply to them as they dont have a (designated list) of wav taxis -even though they have an approved list that has been passed for my licensed area and like myself are goverend and can only put on wav taxis on that list- if you cant assist on medical grounds people in wheelchairs ect dundee city council keep a record of your medical history in case anyone makes a complaint against you -so why is it dundee city council dont have a (designated list) and why wont they issue exemption certificates to allow drivers to display them to allow the general public and taxi drivers no that they cant assist i myself feel this is a failling to the general public and to taxi drivers- is the council holding back exemption certificates under the act becouse it causes problems with the mixed fleet policy For instance if someone gets granted an exemption and can never assist people in wheelchairs why should that person have to place in sevice an expensive wav taxi is this one of the reasons that dundee city council dont issue exemptions how does the bigger cities deal with exemptions.

Edinburgh you get a doctors certificate to say you can't assist, take it to council and they grant you an exemption.

You get it to keep on your person and show if needed. My missus has a temp one due to a recent minor op we drive same cab I still do wheelchairs. Its held by driver not vehicle.

All you need do is to conduct a Health and Safety Risk Assessment, and you are off the hook because the law requires you to do just that. :-| Whether or not you are fit enough to do the job, is irrelevant, if you consider the job to be unsafe, which it is. :-|

Go to the HSE website and download a risk assessment form or knock one up. It's a piece of pi** and keep it in your taxi, and if anyone complains, hand over the form with no further comment. The council or the Cab Inspector is not allowed to second guess your assessment of the situation. You are self-employed, and it is up to you to determine what is safe or not, just make sure you follow the correct procedure by conducting your own risk assessment.

You do realise you are being assessed on your fitness to do a job that under normal conditions of employment would be illegal for health and safety reasons. This is why they use self-employed compliant monkeys as the service provider. The responsibility if something goes wrong is all yours. #-o
