Minicab driver, uncle and nephew 'raped drunk schoolteacher on park bench after abduction'

Accused: A group of men are accused of raping a drunk school teacher

A minicab driver, his uncle and nephew are accused of raping a drunk schoolteacher on a park bench after abducting and trafficking her from his minicab, a court heard.

The unconscious woman is alleged to have passed out after drinking at a birthday celebration before she came round to find one of her abusers having sex with her.

Private hire driver Tamseel Virk, 42; uncle and nephew, Azad Raja, 38, and Wakar Akhtar, 21, along with Najeem Ul-Saeed, 31, all of Bradford, West Yorks, are standing trial at Bradford Crown Court accused of conspiracy to rape between May 25 and 26 this year.

Prosecutor Andrew Kershaw told the jury that Virk picked up the woman from a street in Leeds, West Yorks., in breach of his licence, shortly before midnight on May 25.

Mr Kershaw suggested the fare was not reported to Virk's controller because he had identified a vulnerable woman who could be sexually exploited.

The court heard she was 'noticeably affected' after drinking lager and whisky in a pub with friends, 'talking gibberish' and left her jacket, handbag and phone behind.

Mr Kershaw said Virk 'delivered' her to Akhtar and Raja, getting her to commit a sex act on him on the way.

The jury heard she was dropped off near their home and raped in turn on a bench in Great Horton Park, Bradford, while she was unconscious.

Mr Kershaw said: "They manhandled her, causing bruises and minor injuries to both of her knees, as if she were put in a kneeling position on the ground."

The jury was told the victim woke up while Raja was having sex with her. Akhtar is alleged to have told her he had already had sex with her.

Ul-Saeed, the lawyer added, then turned up 'too late physically to join in the rape that he had set up.'

Mr Kershaw added: "The prosecution case is that there was a conspiracy to rape (the woman) while she was in no fit state either to consent or resist.

"Akhtar and Raja conspired to rape her because they both agreed to do so; to take delivery of her and rape her together in each other's presence.

"Virk, the prosecution say, is part of the same agreement because he delivered the girl to Akhtar and Raja for them to rape her.

"Virk knew that she was in no fit state to consent or resist because he had been able to abduct her to Great Horton Park, rather than take her home.

"Ul-Saeed is also part of the same agreement because he trafficked her from Virk to Akhtar and arranged where and to whom she was to be delivered; he tried to organise a hotel room and attended at the park to join in but was too late because she had regained consciousness by then."

The four men deny the charges and the trial continues.

you mean using a licensed vehicle - going into another area that has no enforcement powers over you - and committing (allegedly) a serious criminal offence?

Where does it say he was not in the area that he was licensed in?

It doesn't but it is implied because he picked her up in Leeds and then took her to Bradford to a park there. He lives in Bradford and as discussed in another thread why would you license yourself in the area you work if you live elsewhere?

I don't think it is implied in the story at all. It is implied by CC. Correct me if i am wrong but the distance from Leeds to Bradford, centre to centre, is only around 11 miles. Hardly a long way. We have drivers here who live a lot further from the centre of our town but are still living within the borough. We also have drivers who live closer than that but live outside the borough but they are licensed by and work in our borough. Until very recently we had a driver licensed here and working here who lived over 100 miles from here in Rochdale.

Well before it was implied by CC I assumed he was out of area because he picked up contrary to his license, as we know assumptions can be wrong. Lets be realistic here, Bradford and Leeds are not Melton Mowbry and Rutland, you have lots of green stuff between each other. One would have to wonder why somebody would travel over 100 miles each day for work :?

personally, I'd make the operator liable for the movements of his vehicles whilst their at work - perhaps they should sit in the next cell

School teacher was 'enthusiastic participant' in sex session, rape trial told

A SCHOOL teacher who says she was unconscious when she was raped by two men on a park bench in Bradford was an "enthusiastic participant" in the sex session, it was alleged yesterday.

Cross-examining her, barrister Elyas Patel suggested to the jury she had instigated and encouraged what happened.

Mr Patel was asking questions on behalf of Wakar Akhtar, 21, of Hudson Avenue, Canterbury, Bradford.

Akhtar and three other Bradford men all deny conspiracy to rape the teacher, between May 25 and 26.

The jury at Bradford Crown Court has heard that she became intoxicated on a night out in a pub in Leeds and was unable to remember calling a minicab to take her back to Bradford.

She left her bag, jacket and phone behind and was "talking gibberish" when she left her friends without saying goodbye.

The woman told the police she thought her drink might have been spiked.

She says she came round on a metal bench in Great Horton Park to find a man having sex with her. Another man, sitting beside her, told her he had just had sex with her.

Also on trial are private hire driver Tamseel Virk, 42, of Marten Road, Canterbury, Bradford; Azad Raja, 38, of Hudson Avenue, Canterbury, and Najeem Ul-Saeed, 31, of Beaumont Road, Girlington, Bradford.

Virk is accused of ringing Ul-Saeed while he was driving the woman from Leeds, who in turn arranged for him to 'deliver' the intoxicated woman to Akhtar and Raja, who then raped her in turn.

Andrew Kershaw, prosecuting, said DNA evidence supported the woman's evidence that sexual activity took place with both men.

He alleged that Ul-Saeed then turned up at the park, "too late physically to join in the rape that he had set up".

After the jury had watched the woman's recorded police interview, she answered questions in court from behind a red screen.

Mr Patel put it to her: "What happened in that park was sex, pure and simple, nothing more and nothing less?"

He continued: "I suggest it was sex between consenting adults, all of whom were active, voluntary and enthusiastic participants in what went on?"

The woman denied this, saying she had never done anything like that before in her life.

She was intoxicated, scared and left bruised and in pain.

Mr Patel went on: "Are you crying rape because you regret what happened? Is that what this is all about?"

The teacher told the court: "Definitely not. This is the most humiliating experience of my life."

She added: "It was life destroying. I did not expect anything like this to happen to me."

The trial continues.

Well if you was more clear with what you wrote I wouldn't have to assume anything would I and I didn't assume I said "one would have to wonder" that is not assuming it is wondering. So anyway I'm still wondering why somebody who lived over 100 miles away would travel that far on however many days he/she did for work
