Bare-chested Fenton drinker kicked and punched taxi driver in Hanley assault

BARE-CHESTED Lance Henshall kicked a taxi driver in the face and rained punches on him as he lay on the floor.

The 24-year-old took off his top and told Sajid Khan, ‘You do not know who you are messing with’, as he assaulted him in Hanley city centre.

The attack came to an end when the driver said, ‘I give up’.

Now Henshall has been ordered to complete 150 hours unpaid work and pay his victim £150 compensation.

Prosecutor John Peel told North Staffordshire magistrates Mr Khan went to pick up a fare in Old Hall Street, Hanley, at 11.20pm on August 10.

The defendant and his friend got out of another taxi and walked over to his vehicle.

Mr Peel said: “The defendant came over with a bottle, the witness said.

“He said, ‘You do not know who you are messing with’, with a clenched fist. He pushed him twice in the chest.

“Mr Khan told the defendant to go away and told the other male to leave, which he did.

“The defendant lifted a glass bottle over his head.

“The victim feared for his safety. He pulled out a torch from the driver’s door pocket.

“The defendant took off his top and was bare-chested. He swung the glass bottle but missed.

“The witness said he attempted to hit the defendant with a torch.

“The defendant put the bottle down and ran at the victim.

“He kicked Mr Khan in the left side of his face. He fell back on the road and the defendant was raining punches with both clenched fists, while constantly shouting, ‘You do not know who you are messing with’.

“The victim said, ‘I give up, I give up’.”

Mr Khan was left with a graze and swelling to his left cheekbone, swelling over his right cheekbone and a cut inside his mouth.

In his police interview, Henshall said the taxi driver was ‘kicking off’ on the other driver and he told him to shut up.

He denied pushing the driver in the chest and holding anything in his hands. He accepted taking off his top and was getting ready to fight as the driver came at him with a torch.

He accepted he did kick the driver on the side of his hip but disputed kicking him in the head.

Henshall, of Hardinge Street, Fenton, denied assault but was convicted after a trial.

Robert Glenn, mitigating, said Henshall stated he acted in self-defence.

Mr Glenn said: “He was in another taxi when the taxi driver turned up and had an argument with the driver. They left the taxi. The taxi driver refused to take them home.

“He was bullied as a child, that is why he stood up to the taxi driver. He may have acted differently if he was not under the influence of alcohol.”

At the trial, the magistrates found any force used by Mr Khan was justified and the degree of force used by Henshall was not reasonable.

Henshall must also pay £650 costs and a £60 surcharge.
