Taxi driver in appeals bid



THE first appeal against a new-style penalty points system for taxi drivers will be heard by North Lincolnshire Council this week.

A driver will put his case to the licensing (miscellaneous) sub committee today (April 16).

The penalty points system was introduced by the local authority to deal with Hackney carriage and private hire drivers, proprietors and operators who commit offences or breach their licence conditions.

A council spokeswoman said: "Before the adoption of the scheme, the only option would be to ether prosecute (criminal offences) or remove a person's livelihood (breach of conditions or criminal offence) or do nothing.

"In some cases those options are either not enough or too much.

"Therefore the points system was devised to provide a middle ground.

"It acts as a warning, but does not cost the driver financially, which a prosecution could and it means that doing nothing won't be an issue.

"The points are on the licence for a limited time after which they are removed. In addition, points will only be attached following an investigation and we will act in a reasonable way when attaching them.

"Should a driver be aggrieved then there will be an appeals process in place."

they don't need a points system - its bullsh*t - its council officers sitting in a room making decisions with virtually no appeals procedure - because they're imaginary points. The entire thing is an illusion.

If a driver is being reprimanded he should have an appeals process - the chances are the driver will accept the points because he would rather accept them than face a committee or take the time off work.

Whats wrong with a verbal warning, a written warning, an appearance in front of a council panel.

The council come across as saying there's no alternative but the points system - of course there is - its just they are sh*thouses.

An alternative licensing system? Yes OK how about a VOSA style body - they couldn't be any worse than the bunch of morons running the licensing system in certain areas could they.

Other than the last para all you raise would be a simple job for any competent Union official ffs its childs play.

vosa never inspired me and their difficult to influence, local councils easy in comparison given Union, politically active cabby's .............oops no chance of that their too fekking thick ...............so they get mullerd serves them right some might say ............................ie MEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEE :badgrin: :badgrin: :lol:

Points systems, like them or loathe them they seem to be legal. I have advised drivers here to appeal every point they get because it isn't the last 3 points that will cost you your badge, it is the ones before. You may get 3 lots of 3 points over a few months for a dirty car but then you may get 6 points for refusing a fare and you will quite likely lose that appeal but because you have already accepted 9 points you will be over the threshold for further action. Apart from that if every driver appeals every point it may take up so much of the Councillors time that they may bin the system.
