Interesting but I think they aren't the best folks to test in court the self-employment scam.

Uber allows them to work with whom they please, and that will be a major issue.

They should have gone for the likes of Addison Lee that forbid you working elsewhere. They also supply the vehicle and insure it.

I thought that was your meaning and I agree with you. But it could be stretched to cover all PH circuits possibly.....

I am surprised that it has not been done before, but this could open the door, win or lose, depending on the wording of the judgement if it goes the distance, for a raft of claims for similar.

I just wish a bit more thought went into the target, cos I'm not convince Uber are the ones to get the best result from.

As I said, depends on the wording the Judge uses.

Let's assume the drivers lose, the Judge may say along the lines of "...not tied in any way to only working for UBER..." It would leave the door wide open for PH drivers who are tied in to only one circuit.

Circuit owners would look at the trade they generate. If they reckon they can cover it with 100 drivers, they would hire, maybe 110 to cover holiday/sickness etc. and see how it goes. Too many drivers and they don't replace retirees or others that leave. Too few they take on some more.

The days of taking a rent or settle from more than needed would be over, drivers that make the "cut" could and would do well, those that don't will struggle.

If it happened, I foresee the numbers of PH dropping, and Hackney numbers in non-restricted areas increasing at least in the short term. It would actually be the market forces deciding the numbers.
