Downing Street taxi protest against “rapist” minicabs leaves London’s roads in chaos Cab drivers demonstrate outside over private hire rules It’s yet another transport dispute that isn’t being resolved and, yet again, Londoners are going nowhere. Black cab drivers in the capital staged protests today over the safety standards of private hire vehicles. Claiming “no woman is safe in a minicab”, the drivers blocked roads in Whitehall and across London for a two-hour protest at 11am today. The protest was organised by the United Cabbies Group (UCG) who said Transport for London has dropped the requirement for minicab drivers to have a full criminal background check, while black cab drivers still need to comply, which can take months to complete. The union said: “The upshot of this is that members of the public can now listen to free music on their mp3 players whilst being driven around by rapists or murderers. There are over 100 reported sexual assaults in minicabs in London every year and we know less than 10% of rapes and sexual assaults are reported.” source: http://www.londonlovesbusiness.com/busi ... 03.article |

TfL Foreign convicts allowed to work as taxi drivers without disclosing crimes Licensing authorities in London are not allowed to carry out background checks on asylum seekers and refugees Foreign convicts could be given jobs as taxi drivers because of a legal loophole preventing employers from checking their records, it has emerged. Licensing authorities in London are not allowed to carry out background checks on asylum seekers and refugees in case it damages their case. The gap in the rules is spelled out in a Transport for London document on “private hire driver licensing” applications. The form states: “With regards to overseas criminal records checks, no such checks will be made in respect of those applicants who declare that they are in possession of or who have applied for refugee or asylum status.” Conservative MP Nick de Bois told the Daily Express: “They should not be offering licences to those they can’t check on. They could be putting vulnerable members of the public in the hands of thieves, murderers and rapists. It beggars belief.” Every driver who applies for a taxi licence is meant to go through checks to reveal any criminal past. Those from outside the EU who have spent more than three months abroad in the past three years have to provide a “letter of good conduct” from their home embassy. But asylum seekers or refugees are rarely able to supply a certificate from their home country. That means they are exempted from having to disclose all their possible convictions. TfL’s Helen Chapman said: “Any applicant that has lived in a country other than the UK for more than three months within the last three years is required to produce a certificate of good conduct. “We recognise this may not be possible if an applicant is granted asylum or refugee status and, where applicable, these applicants will be required to provide a certificate from any other country of residence within the last three years. They will also be required to provide evidence of their certificate of registration or a letter from the Border and Immigration Agency.” http://www.telegraph.co.uk/news/uknews/ ... rimes.html |

http://content.tfl.gov.uk/driver-operat ... elines.pdf Where an applicant is unable to provide the above they must explain why and provide references from individuals/bodies who can confirm their conduct for their time in the country (the referee must not be a family member). The absence of a ‘Certificate of Good Conduct’ or references will not prevent an application from being considered but the failure to do so will be taken into account at the decision making stage. Each case must be considered on its merits. Particular consideration will be given to assess whether the applicant has demonstrated that they have provided all the available evidence or made every effort to obtain the information. 3.3.11 Asylum seekers Any applicant who has been granted or is awaiting a decision to be granted asylum/refugee status will not be required to produce a Certificate of Good Conduct from the country he is claiming asylum from. The applicant will, however, be required to obtain a Certificate of Good Conduct from any other country he has resided within the three years prior to the date of application in line with the guidelines at paragraph 3.3.10. To gain this exemption, the applicant must provide a clear and legible photocopy of either his Certificate of Registration or a letter issued by the Border and Immigration Agency, an executive agency of the Home Office. |
