Uber faces its first UK legal action to see if it should pay workers for holidays and pay the National Minimum Wage

Uber, the company behind the taxi hailing app, faces its first legal action in the UK this week over whether its drivers are workers or self-employed.

The US-owned firm will appear in a case brought by law firm Leigh Day, supported by the GMB union, at the Central London Employment Tribunal on Wednesday.

It will decide if Uber, whose European headquarters is in the Netherlands, is acting unlawfully by not providing drivers with holiday pay or the National Minimum Wage.

A successful claim against Uber could have ramifications for workers classed as self-employed in other industries, said Leigh Day.

Odds on that Uber will win drivers own their own cars and are free to take work from other Apps so difficult to get them classed as employed

The only way is to get the government to bring in legislation requiring all operators to top up earnings if they don't provide sufficient work to earn minimum wage

I wish the GMB had challenged another firm that doesn't allow drivers to work elsewhere.

However they are going on the holiday and minimum pay issue, which might win.

If a person works part time for one firm, and part time for another, they are entitled to receive those benefits pro rata.

It will be interesting to see how it goes.

I would love the GMB to win, then every driver in the UK would have to be employed, just think how many taxis and PH cars would disappear within a short spell, due to owners not having the money to pay them, I would then get a space on our overflowing rank

Yes, everyone of them owner drivers that work the ranks would have to form themselves into limited company's and set up a paye scheme and automatic pension enrollment. They would love that.

Wouldnt like to place abet on this one you can never tell with ET's.

This case will cost the GMB considerable ££££££££££££'s is it worth a punt ?? personally always prefer the INDUSTRIAL route but yer need boloxs for that something the GMBPDB are short of :D

Of course should the GMB win their gormless Branch Sec's company will come a cropper for he abuses employment law as much as UBER, amd should any lawyer want proof they only have to contact old TT be my pleasure to assist he's abused and exploited employees :badgrin: :badgrin:

Most of the comments on here demonstrate an appalling lack of knowledge #-o regarding Employment Law #-o

No they are taking a commission off the top much like a credit card company would only more

But the law states that at all times the punter is a Uber punter, it's never the drivers punter.

amazed at Justin Bowden stating "drivers are forced to work excessive hours" thats admitting that drivers breach knowingly the WTD and H&S regulations in knowingly driving whilst unfit through "sleep deprivation" not that the mug who runs the GMBPDB cares about that for he DRIVES WITHOUT ADEQUATE REST CONTINIOUSLY.

He claimed "two thirds of new partner drivers joining the Uber platform have been referred by another partner.”

probably because they are all trying to find a job for their friends and relatives newly arrived in the UK
