Additional information to be submitted with ALL Applications for Taxi and Private Hire Driver Licences

Under the provisions of the Immigration Act 2016 which came into force on 1 December 2016, Scottish Borders Council will not be able to issue a taxi or private hire car driver licence to any person unless a check has first been made to confirm that the person is not disqualified by reason of his or her immigration status from driving a taxi or private hire car.

This will mean that all applicants for taxi or private hire car driver licences, including UK passport holders, will need to attend their nearest SBC contact centre or licensing office, Newtown St Boswells, in person with their original document(s) demonstrating that they have the right to work in the UK. Acceptable forms of id are as detailed below. Staff will require to check the validity of the original documents in the presence of the applicant before the licence can be issued and the Council is required to retain copies.

Please note that the checking process is required both for new applications and renewal applications.

Acceptable forms of id

· If you are a British Citizen please provide your current passport with the application. If you do not have a current passport, then please provide your birth certificate along with either your National Insurance Card or most up to date P60/P45 or a recent document with your National Insurance number on it.


· If you are an EU National please provide your passport or National Identity Card with the application.


· If you are not a British Citizen or an EU National, please provide your passport and residence permit confirming your immigration status and right to work in the UK.

If you need any more information or have any questions about the new requirements, please contact me.

Personally I think that it is a good! The more bad guys that they catch/deter from taxi work (because they are not legally in this country/their documents are not legal etc), then the better it will be for you. At least you seem to have a Council that is taking action, as opposed to those who will turn a blind eye and just take the cash.

It appears that the council want to play by the rules, but won't issue a 3 year drivers badge

What affects us as far as the SBC LA is concerned is all in here:

Though I reckon the Council is Mis reading the act...It reads:

When will this guidance be relevant?

The checking requirements are not retrospective. This means that licensing authorities do not have to check the immigration status of those people who already hold a
PHC or taxi driver’slicence which was issued before 1 December 2016 or sent their licence application to the licensing authority before this date.

The check must be performed when the applicant first applies i.e. sends the application for a licence to the licensing authority or first applies to renew their licence or extend their licence
on or after 1 December 2016.#


Apostmark may be acceptable evidence of date of application


Those of us who's renewal is not our first renewal should not be require to do all this....It simply says First Applies....In my case I've applied about 5 times for renewal over 15 years...

How would you read and interpret "First Applies to Renew" it, does anyone else do this? if it meant otherwise it would simply have read "at Renewal" and not at "First Renewal"

Nowt to do with 3 Year licences...they are still just the same, it's only when you need to renew yours at the end of a 3 year period like we normally do, they'll still be 3 years and this is a one off proof that we British ain't Illegals in our own country....mean time the country floods with illegals and we Brits get the UK inquisition at our door.

It's a waste of time, All my family history, NI number and place of Birth is all shown on my Police Enhanced Procedure Check (CRB) and on my PVG (protection of Vulnerable Groups) certificate and on my DVLA drivers license...for Feck sake can't they bloody see that???

Is the 3 year license the same in Scotland as it is in England and Wales?
My advice to anyone who is not happy to provide the details required should simply not provide them. Go and get another job where you are not required to provide the information. However you may find that you may need the information for any job, anywhere before long.

This is in the Scottish section of the Act and seems only to Target PH and Taxi drivers.
