Convicted Harlow fraudster continues to legally take fares as taxi driver despite having his licence revoked by council

A trade union has expressed its concerns after a Harlow taxi driver who had his licence revoked after he was convicted for fraud, managed to find a loophole in the system and keep his job. shock horror

The driver, who had his licence revoked by Harlow Council in 2016 and unsuccessfully appealed in Magistrates' and Crown Court later that year, managed to continue working as a private hire driver for ABC Cars in Harlow after being granted a licence from Epping Forest District Council.

Unite the union, one of the largest trade unions in the country, has called it a "mockery of local enforcement" and a "waste of taxpayers' money".

A spokesperson said: “Our concerns are that if Harlow Council decide that a driver is not a fit and proper person to convey the travelling public of Harlow and revoked their licence, then it cannot be right that that driver can simply get a licence from a neighbouring district that clearly have lower standards with the full intention of returning to Harlow to work for the same minicab operator.

“The use of a loophole in poor legislation has made a mockery of local enforcement and licensing and resulted in a complete waste of Harlow taxpayers’ money after Magistrates' and Crown Court appeals.

“The mini-cab company in question should bear some responsibility for this having shown no respect for Harlow Councils decision taken to protect the public of Harlow.”

The driver in question had been working for ABC Cars for more than 16 years and his employer has said that they have never had a single complaint against him.

Nick Jones, Director of ABC Cars, says that the driver shouldn’t have had his licence revoked in the first place.

He said: “The driver concerned was treated unfairly. He had his licence taken away because of a crime that had nothing to do with private hire work.

“It is really an opinion of Harlow Council and Epping Forest Council. Harlow Council saw him as an unfit and unproper driver. He had his licence revoked so he stopped working for my company.

“Epping Forest said he was a fit and proper driver and gave him a licence, so I hired him back.

"It is not illegal. If you can get a licence from any town, you can use it anywhere else.”

Harlow Council have agreed that a change in the current legislation would need to be made to make sure the decisions they have made in licensing are upheld.

A spokesperson for Harlow Council said: “We are very concerned that any person who has their licence revoked by us can potentially serve the people of Harlow under a different licence from a different authority. The current legislation would need to change to stop this happening.

"We take our responsibilities as a licensing authority very seriously and we ensure that every driver is a fit and proper person to be licensed to drive a private hire vehicle or a hackney carriage vehicle.

“The licensing policies put in place and decisions taken by other licensing authorities are a matter for those authorities to justify. Unfortunately, we have no input or influence over any other council's licensing decisions."

Think they should look into this operators license,they are clearly not fit and proper if they believe a convicted fraudster should be licensed.
Epping Forest District Council licensing committee and Officers should also be investigated as they are not following the guide lines on convictions.

and its only legal if the driver is now a taxi driver exploiting cross border, or a PH driver if ABC is receiving work from an operator in Epping Forest

Until someone fixes the cock-up of the 2015 Deregulation act ..it will stay the same..
