Banned Mansfield taxi driver who wanted oral sex for payment loses licence appeal




Magistrates have dismissed an appeal brought by a Mansfield taxi driver after his licence was revoked for requesting oral sex to complete a journey. Mr Nazmul Hassan, 33, has also been found guilty of watching moving images on his mobile phone, which caused him to drive in an erratic manner. He had brought the appeal following revocation of his driver’s licence by Mansfield District Council in August last year. Two female passengers gave evidence at court that the driver had made an inappropriate request of a sexual nature to them after a night out. Further allegations were received from two witnesses about the same driver viewing moving pictures on his mobile phone whilst driving erratically. Mansfield District Council revoked the driver’s licence in August 2017. The decision was appealed and District Judge Spruce, who heard the appeal on on January 22, found the witnesses’ evidence to be honest, credible and reliable. Consequently, the appeal was dismissed.

The judge upheld the Council’s decision finding that the allegations made were, separately, of a serious nature and each could justify a revocation.

He also found that the council, as a licensing authority, were not wrong to revoke licence. Mr Hassan was ordered to pay the council £2,800 in legal costs for bringing the case to appeal.Jacqueline Collins, Mansfield District Council’s director of Governance and Monitoring Officer, said: “The safety of the public is a paramount consideration for a licensing authority and we will not allow this to be compromised. “Mansfield District Council requires the highest standards for all drivers and operators and will not hesitate to take action against those failing to meet those standards.

“I would also like to thank those members of the public who took the time and trouble to report their concerns to the council and to give evidence at court. Without their assistance Mr Hassan would still be operating as a taxi driver.”

I often wonder why people appeal against revocation when a number of people allege separate sexual assaults.

I conclude that they are just dumb, and the trade is best rid of them.

There a bad lot in Mansfield

4 drivers licences relinquished.

• 14 drivers have been awarded Penalty Points for the following offences. Two of these drivers will be referred to a Panel as they have accrued 12 penalty points within a rolling 12 month period:
Refusing to accept a legitimate fare from the rank
Failing to report an accident
2 x Dangerous Parking
6 x Parking in a No Waiting Traffic Restriction Order area causing an obstruction to other road users
Illegal Parking on “Zig Zags” outside a primary school
Smoking in a vehicle
Private Hire Vehicle waiting in a Hackney Stand
Parking within a Disabled Parking Bay

• 1 driver licence suspension - for failing to provide a current DBS Certificate

• 1 Licensing Panel to consider new application due to offending history on DBS Certificate. Panel decision was to grant licence.

• 2 Court cases at Magistrates Court in December to appeal against driver licence revocations. Both cases adjourned, one until January and one until March.


• Prosecutions - Witness statements have been supplied to the Police for them to prosecute a Wolverhampton driver for using a hand held mobile device while he was driving. Once the Police have prosecuted we will be referring this to Wolverhampton Council Licensing Team who have stated that they will revoke the drivers licence.


• 2 Vehicle Suspensions – for non compliance


• 2 Fixed Penalty Notices(Issued by ASB Team).Witness statements supplied to ASB Team to prosecute 1 x Hackney Carriage Driver and 1 x Member of Public who were seen to drop litter on Clumber Street.


• A letter was recently circulated to Members from Ben Bradley MP in response to MDC raising concerns regarding out of district drivers. Mr Bradley confirmed that he has written to the Minister for Transport highlighting the concern with the current legislation. Once a further response is received from Mr Bradley an update will be provided to the Committee.
