Gloucestershire student killed walking home from party 'jumped out' in front of taxi

https://www.gloucestershirelive.co.uk/n ... me-1668731

A 19-year-old Royal Agricultural University student was killed when he 'jumped out' in front of a taxi while walking home from a party, an inquest has heard.

Jonathan Hulley, known as 'Jobo', could not be saved after being rushed to Southmead Hospital in Bristol following the incident September 30 last year, Gloucestershire Coroner's Court was told today.

The taxi driver whose car struck him on A433 Cirencester-Tetbury road in the early hours said it was impossible for him to avoid the student.

Mr Hulley, the inquest heard, had more than twice the alcohol limit for a driver in his blood, had taken ecstasy, and had 'very low levels' of cocaine and ketamine in his system.

The taxi driver who hit him told police he had 'jumped out' into his path and other witnesses said Mr Hulley was walking on the oncoming lane midway between the verge and the central white line.

Gloucestershire coroner Katie Skerrett recorded a conclusion that he died from a road traffic collision.

He was living in student accommodation at the Cirencester-based university at the time of his death but his home address was in Hoxne, Suffolk.

The inquest was told he had been to a party in Tetbury Road, near Cirencester, and was walking home with others at 5.25am.

He was hit by a Vauxhall Zafira taxi driven by Eseroma Nasilasila, who was on the way to pick up someone else from the party venue.

Police collision investigator Simon Wilson said the collision happened near the A429 Kemble junction.

"There had been a large party at a rural location nearby," he said. "The road was dark and it was difficult to see pedestrians."

The officer said a witness, who was driving his wife to work early that morning, said it was difficult seeing the pedestrians because of the dark conditions under the trees.

A friend who had been walking a short ahead of Mr Hulley said they had both been drinking and his recollection of events was hazy.

"He said that the last time he saw Jonathan he was between the verge and the centre white line," the officer said.

PC Wilson said the taxi driver had stated that he slowed down when he saw some pedestrians in the road ahead. He then became aware of Mr Hulley and his friend, and 'one of them jumped across into the carriageway leaving him no chance to stop'.

The officer said the cocaine and ecstasy Mr Hulley had taken could have made him more extrovert and confident, possibly over-confident.

"I think the alcohol and the drugs are the main contributory factor in this collision," he said.

"Also, the dark clothes in a very dark area, a tree lined avenue. Some of the trees joined at the top to form a canopy over the road. I believe the driver could not have avoided the impact."

Recording her conclusion the coroner said: "Jonathan was acting under an impairment, the combined effect of the alcohol and the other substances. It would have had a significant impact on how he was able to assess his circumstances, his awareness of them."

Julie Walkling, director of operations at the Royal Agricultural University, said: "Our thoughts and deepest sympathies continue to be with Jonathan's friends and family."

And any sympathy for the cab driver who is going to have this on his mind for the rest of his life?

Doesn’t appear so.

It's disgusting that they did not absolve the driver of all blame and offer him support for the trauma he had to endure due someone elses stupidity....they treat Hacks and PH drivers like they were second class human beings.

Maybe that bit just wasn't reported. Another similar incident just reported, and the taxi driver specifically absolved of blame.

Woman died after being hit by taxi in Porthcawl minutes after she was refused entry to nightclub

Eve Lewis, 22, was fatally hit while walking on a dual carriageway

A 22-year-old who died after being struck by a taxi was walking home after being refused entry to a nightclub, an inquest has heard.

Eve Lewis died from "catastrophic injuries" she suffered in the early hours of March 4 this year.

Giving evidence at the hearing into her death, the driver of a Ford Tourneo minibus which hit her described seeing a shadow in the road a split second before the fatal accident.

Pontypridd Coroner's Court heard how Anthony Shankland from South Cornelly desperately flagged down another road user when he realised what had happened.

He said: “I saw a shadow and I thought it was a large animal because you get foxes in the area.

“It wasn’t until I stopped I saw that it was a young lady on the floor.”

He said he was “driving between 40-45 mph in the left lane of the dual carriageway” in Porthcawl when tragedy struck.

Eve was taken by ambulance to Princess of Wales Hospital in Bridgend.

According to a statement from Dr Laura Harvey who treated her she had suffered a “catastrophic brain injury” which nobody could survive.

Toxicology reports revealed the popular prison officer has a level of alcohol in her system equivalent to being three times over the drink drive limit.

The inquest heard how she had been refused entry to Streets Nightclub in Porthcawl around 25 minutes before being hit by the taxi.

Other drivers reported seeing her walking along the dark carriageway.

PC James Littlewood, who investigated the incident, said: “Her clothing of black top, black trousers and black boots would not have made her stand out against the dark asphalt.”

In summing up, Coroner Christopher Woolley found Eve’s death was the result of a road traffic collision.

He said: “Eve attended a night out with her friends in Porthcawl.

"According to the toxicology report she had a lot to drink and was three times of the legal drink drive limit.

“At 1.20am she went to Streets Nightclub and was refused admission.

"She was spoken to by staff and accepted it very pleasantly.

“She was encouraged by staff to take a taxi home but she insisted she was OK.

“She seemed to walk home. It is a mystery why we chose to walk home along the route she took.

“She was well into the carriageway and a driver had narrowly avoided her. Another had stopped his car and told her to get off the road.

“Mr Shankland was driving his taxi. He had not drunk at all, was perfectly sober and driving within the speed 50mph speed limit.

“I am satisfied that he had no chance to avoid Eve. There was no time to brake or think, let alone avoid.

"I absolve him completely from any blame, he behaved responsibly.

“The injuries to Eve were so severe she may not have been aware of being struck.

"A CT scan showed damage to her brain, heart and possibly liver.

“There was no real street lighting at the scene and the road was wet.

“I have found no culpability on behalf of anyone let alone Eve. I find it is the result of a road traffic collision.

“She died at the Princess of Wales Hospital in Bridgend. The cause of death was a brain injury."

Regarding the section of road, he added that as the road was not supposed to be used by pedestrians “there are little changes that can be made that would prevent a similar incident”.

In a statement, her family said: “We as a family are devastated by what has happened.

"We wish to be left alone to grieve in privacy but are grateful for all the support we are receiving.”

15-year old killed in collision with PH in Fife late on Saturday night, although precise circumstances obviously still not known.

And black cab involved in hit and run in Edinburgh at weekend, with pedestrian seriously injured. Apparently wing mirror off vehicle, so police saying driver would almost certainly have been aware of collision.

Yes, maybe if he'd hit a drunk in the early hours up some darkened side street then the driver might realistically think they could get away with it.

But 4pm Saturday afternoon on Princes Street, perhaps Scotland's best-known and busiest shopping street...
