Pervert taxi driver who molested young female passenger claims jurors were wrong to convict him

Taxi driver Hikmet Kaya, who molested a teenage passenger, claimed jurors were wrong to find him guilty.

The 44-year-old received an eight-month suspended jail term following a trial at Stafford Crown Court in July 2014.

But he then appealed the verdict and took it to the Court of Appeal.

Mr Justice Popplewell told London's Appeal Court Kaya was convicted of sexual assault four years ago.

The court heard in 2013, Kaya, from Riverside Mews, Stafford, collected the victim who sat in the front of the taxi with her friends in the back.

Halfway through the journey, he took her hand and put it on his crotch area, over his trousers, and tried to make her fondle him.

Kaya then put his hand on the teenager's thigh and, when she moved it, he grabbed her hand 'firmly' and made her fondle him again.

Appearing at court yesterday he argued that his conviction was 'unsafe' and should be overturned.

The case against him 'was a weak one and the jury were wrong to find him guilty', he argued.

But Mr Justice Popplewell, who was sitting with two other judges, observed: "This is not a good ground of appeal."

It was for the jury 'to decide if it was sure Kaya was guilty and it did so decide', he added.

Kaya also claimed his trial barrister had let him down.

But, dismissing the appeal, the judge concluded: "There can be no valid criticism of the way in which his counsel conducted the trial.

"This was a straightforward trial in which all matters that were pertinent to the defence were raised and the jury ultimately believed the complainant and not Kaya."
